RESOLUTION NO. 74-35 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR THE CONSTRUCTION OF DEVELOPMENT IMPROVEMENTS AND LANDSCAPING OF THE UTT-MITCHELL PARK AND AUTHORIZING THE CITY CLERK TO ADVERTISE BIDS. %~IEREAS, it is the intention of the City Council of the City of Tustin, California, to construct certain improvements and landscaping of the Utt-Mitchell Park and WItEREAS, the City Engineer and Parks and Recreation Director have presented plans and specifications for the construction of said work at this location. · NOW, THEREFORE, be it resolved that the authorization to advertise for bids is hereby approved for the construction of development im- provements and landscaping of the Utt-Mitchell Park. BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to advertise as required by law for the receiPt of sealed' bids or proposals .for the doing of the work specified in the afore- .said plans and specifications which said advertisement shall be. sub- stantially in the following words and figures, to-wit: "NOTICE T~ CONTRACTORS" SEALED PROPOSALS will be received at the office of the City Clerk, · . Tustin City Hall, 140 West Second Street, Tustin, California, until 11 o'clock A.M. on the 12th day of June~,~!?~74, at which time they will be publicly opened and. read, for performing Work as follows' In the CJ. ty of T,.~t~p~ deve~.npm~nt ~mprnvmm~.nt,~ and ].andscaping the Utt-Mitchell Park. Bids are required for the entire work as described in the Bid Fo.rm. Plans, specifications, and proposal forms to be used for bidding on this project can only be obtained at the Tustin City Hall, Tustin, California. In conformance with Section 37931 of the Government 'Code, all bids shall be presented under sealed cover on the proposal form pro- vided and accompanied by one of the following for~s of bidder'·s security' a. Cash b. Cashier's check made payable to the City of Tustin c. Certified check made payable to the City. of Tustin d. "Bidder's bond executed by an accredited' surety insurer, made payable to the City of Tustih 444 · The security s~all be :[.n an amount equal to at least ten percent (10%) of the amoun~ of the bid. A bid shall not be considered unless one of the forms o~- bidder's security is enclosed therewith. A Surety Bond for payment o[' labor and materials will be required in the amount of fifty percent (50%) of the estimated total contract price 'and a Faithful Performance Bond in the amount of one hundred percent (100%) of the estimated total contract price in the form attached to the contract documents. Said bonds s}~all be issued by a company having a rating of A+AA or better. City of Tustin reserves the right to reject any or all bids, and/or waive any informality on a bid. No bidder may withdraw his bid for a period of thirty (30) days after the date set for the opening thereof. The contract will be awarded to the lowest qualified bidder, based on the Lump Sum Grand Total of the Base Bid plus the Alternates, if any, the City accepts.. The Owner holds the right to select and/or refuse any one or combination of or all of the Alternates. Provisions of the State Contract Act are not applicable, and prospective bidders will not be required to be prequalified. Ail work to be done under the direct supervision of'the City Engineer or Director of Parks and Recreation, City of Tustin. .. Ail work to be paid for at the lump sum bid price's from appro- priate monies. . Said City of Tustin, pursuant to the Labor Code of the State of California, has ascertained and determined that the general prevailing rate of hourly and per diem wages in the locality in which the said.' , work herein described is to be performed, for each craft or type of workman or mechanic needed to execute the contract and also the general prevailing rate for legal holidays and overtime work for each craft or type of workman or mechanic, to be as indicated in Resolution 70-42 file 'in the office Of the Cit~ Clerk. Employer payments other than those itemized therein, as defined in Section 1773.1 of the Labor Code, are to be paid in accordance with the terms of the collective bargaining agreement applicable to the type or classification of the workmen or mechanics employed, on the project. Copies of all collective bargaining agreements relating to the work as set forth in the aforementioned labor code are on file and available for inspection in the office o'f the Department of Indus- trial Relations, Division of Labor Statistics and Research. , BY ORDER-OF TIlE CiTY COUNCIL OF . ..
