RESOLUTION NO. 74-29
·
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN RECOMMENDING APPROVAL OF
THE SOUTHERN PACIFIC RAILROAD RIGHT-OF-
WAY BIKE TRAIL FEASIBILITY AND ENVIRON-
MENTAL IMPACT STUDY.
The City Council of the City of Tustin does hereby
resolve as follows:

1. The City Council finds and determines:
a. A Draft Feasibility-Environmental Impac~
Study has been furnished the City of Tustin
by the Harbor, Beaches and .Parks District
of Orange County for evaluation and conm~ent
related to the development of a Bike Trail
- on the Southern Pacific Railroad right-of-
way, extending from the City of Villa'.Park
to the City of Tustin.
b. That said plan is in substantial compliance
with the General Plan of the City of Tustin.,
c. The development of the proposed Bike Trail
would be a con%munity asset for the residents
of Tustin, as well as to the adjoining City ......
and Com'~'tv residents.

2. The City Council hereby recommends that::
a. The County of Orange be encouraged to
expeditiously acquire and develop the pro-
posed Bike Trail.
b. That the Draft Environmental Impact Study
be certified subject to the following
considerations and amendments.
1) There should be included within tb.e
Environmental Impact Report a section
pertaining to the economic feasibility
as related to acquisition and develop-
ment costs and the means of financing
~' implementation of the plan.
2) An amendment to the Bike Plan, as Pro-
posed, to eliminate the Newport Avenue
frontage trail, and. reroute it south-
easterly along the abandoned Santa Fe
right-of-way or Flood Control property. _ ....

5) A design section of an adequate safety
barrier between a bicycle path and
automobile lane on a major arterial.
6) Further review of the design by the
police agencies of affected juris-
dictions for the purpose of security
and surveillance.
7) Further investigation of the title to
the Newport Avenue frontage in the
Tustin area, based upon the allegation
that the railroad right of way has
reversionary right for street purposes
and would not require the purchase of
the property by Orange County with
the suggested resale to the City of'Tustin
for street purposes.
8) Further design consideration at.the
intersection of the bike .trail with
arterial highways to preclude an adverse
impact upon vehicular traffic.
PASSED AND ADOPTED at a regular meeting of the
Tustin City Council held on ~he 6th day of May, 1974.
