RESOLUTION NO. 73-70
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUST!N, CALIFORNIA~ APPROVING
PLANS AND SPECIFICATIONS FOR THE INSTALL-
ATION OF TENNIS COURT FLOOD LIGHTING AT
TUSTIN HlGtt SCHOOL AND DIRECTING THE CITY
CLERK TO ADVESTISE FOR BIDS.

WHEREAS, it is the intention of the City Council of·the
City of Tustin, California, to install tennis court flood
lighting at Tustin 'High School, and
WHEREAS, the City Engineer has presented plans and
specifications for the installation of said work,

NOW, THEREFORE, BE IT REsoLVE~ that the plans and specifi-
cations presented by the City Engineer be and are hereby approved
as the plans and.specifications for the installation of tennis
court flood lighting at Tustin High School.
BE iT FURTHER 'RESOLVED ~.hat the City Clerk is hereby authorized
and directed %o advertise as required by law for the receipt of
sealed 'bids or proposals for the doing of the work specified
in the aforesaid plans and specifications which said advertisement
shall be substantially in the following words and figures, to-wit-
"NOTICE TO CONTRACTORS"
SEALED PROPOSALS will be received at the office of the
City Clerk~ Tustin City Hall, 140 West Second Street~ Tustin,
California, until 11 o'clock A.M. on the 5th day of November,
1973~ at which time they.will be publicly opened and read, fo~
performing work as follows-
Bids are required for both Alternate "A" and Alternate "B"
described herein.

In conformance wit]] Section 37931 of the Government Code, all
bids shall be Presented under sealed cover on the proposal form
provided and accompanied by one of the following forms of bidder's
security-

a. Cash
b. Cashier's check made payable to the City of Tustin
c. Certified check made payable to the City of Tustin
d. Bidder's bond executed by an accredited surety insurer,
made payable to the City of Tustin
· The s'ecurity shall be in an amount equal to at. least ten percent
(10%) 'of the amount of the bid. A bid shall not be considered
unless one of the forms of bidder's security is enclosed therewit/n.

A Surety Bond for payment of labor and materials will be required
in the amount of fity percent (50°-
-~) of the estimated total contract
price and a Faithful Performance Bond in the 'amoun't of one
hundred percent (100%) of the estimated total Contract price in
the form attached to the contract documents. Said bonds shall
be issued by a' company having a rating of A+AA or better.
City of Tustin reserves the right to reject any or all bids,

The contract will be awarded to the lowest qualified bidder
based on the total, price of either the base bid or the alternate b:d.
Pro'visions of the State Contract Act are not applicable, and
~pr°spective.- bidders will not be required to be prequalified.

~ngineer, City of Tustin.

Said City of Tustin, pursuant to the Labor Code of the State of
California, has a.scertained and determined that the general
prevailing rate of l~ourly and per diem wages in the locality in
whic]~ the said work herein described is to be performed, for each
craft or type of workman or mec]~anic needed to .execute the con trac"-
and also tl~e general prevail, lng rate for legal holidays and over-
