RESOLUTION NO. 73-53
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING PLANS AND
SPECIFICATIONS FOR THE TUSTIN CITY HALL, AND
RELATED SITE WORK AND DIRECTING THE CITY CLERK
TO ADVERTISE FOR BIDS.
W~EP~EAS, it is the intention of the City Council of the City
of Tustin, California, to. construct the Tustin City Hall and
related site work, and
WHEREAS, the Building Official has presented plans and
specifications for the construction of said work at this location,
NOW, THEREFORE, be it resolved that the plans and specifications
presented by the Building Official be and are hereby approved as
the plans and specifications for the Tustin City Hall and related
site work.
BE IT FURTHER RESOLVED that' the City Clerk is hereby authorized
and directed to advertise as required by law for ~-.he receipt
of sealed bids or proposals for the doing of the work specified
in the aforesaid plans and specifications which said advertisement
shall be substantially in the following words and .~i~ures, to-wit-
"NOTICE TO CONTRACTORS"
SEALED PROPOSALS will be received at the office of the City
Clerk, Tustin City Hall, 140 West Second .Street, ·Tustin, California,
until 11 o'clock A.M. on the 17th day of August, 1973, at which
time they will be p~biicly opened and r~ad, for performing work
as fo!lcws-

In the City of Tustin, construction of the Tustin City Hall
and related site work.
Bids are required for the entire work described herein:

Base Bid-Building- Includes heating,
ventilating, air conditioning,
plumbing, electrical and fire
sprinklers.
Base Bid-Site Work. Includes all

drainage, yard work, etc.
The foregoing quantities are approximate only, being given
· as a .basis for the comparison of bids, and the City of Tustin does
not, ~?,×pressly or by implication, agree that the actual amount of
work will correspond therewith, but reserves the right to increase
or decrease the amount of any class or portion of the work~ or to
omit portions of the work as may be deemed necessary or advisable
.and in the best interest of the City .by the Engineer.
Two sets of plans and specifications will be. issued to the .,
Contractor for bidding purposes, upon receipt of one hundred dollars
($100.00)... Make deposit Checks p.ayable to City of Tustin. Additional
sets will be available at a cost of fifty dollars ($50.00). Deposit
will be returned upon return of documents in good condition within
one week after bid opening. Documents are available at the Tustin

In conformance with Section 37931 "Of' the Government Code, all
bids shall be presented under sealed cover on the proposal form
provided and accompanied by one of the following forms of bidder's
security:
a. Cash.
b. Cashier's check made payable %o %he City of Tustin,
c. certified check made payable to the City of ~ustin.
d. Bidder's bond executed by an accredited surety ins'~rer,
made payable to the City of Tustin.
The security shall be in 'an amount equal to at least ten
percent'. (].0%) of the amount of %he bid. A bid shall not be
considered unless One of tJ~e forms of bidder's security is enclosed
therew~.th.

A Surety Bond for payment of labor and materials wi].], be
required in the amount of fifty percent (50%) of the estimated
total contract price and a Faithful Performance Bond in the amount
of one hundred.·percent (100%) of ~he e'stima%ed total contract price
in the form at. tached to the contract documents. Said bonds shall
be issued by a company having a'rating of A+AA or better.
City of Tustin reserves the right to' reject any or all bids,
and/or waive any informality on a bid. No bidder may withdraw
his bid. for a period of thirty (30) ~ays after the date set for the

The contract will be awarded to the lowest qualified bidder, based
on total price and time bid on the alternatives selecte~ by the City of

Provisions of the State Contract A'ct are not applicable, and
prospective bidders will not be required to be prequalified.

Said City of Tustin, pursuant 'to the Labor Code of the State
of California, has ascertained and determined ~that the general
prevailing rate of hourly and per diem wages in the locality in
which the said work herein described is to be performed, for each
craft or type of workman or mechanic needed to execute the contract
and also the genera], prevailing rate for legal holidays and overtime
work for each craft or type of workman or mechanic, to be as
indicated in Resolution 70-42 as previously published in a newspaper
of general circulation, and on file in the office o.f the City Clerk.
Employer payments other than those itemized therein, as
defined in Section 1773.1' of the Labor Code, are to be paid in
accordance with the terms of the collective bargaining agreement
applicable to the type.or classification of the workmen or mechanics
employed on the project.
Copies of al'l collective bargaining agreements relating to
the work as set forth in the aforementioned Labor Code are on file
and available for inspection in the office of the Department of
Industrial Relations~ Division of Labor Statistics and Research.
