HomeMy WebLinkAboutCC RES 73-47 RESOLUTION NO. 73-47 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISH- ING THE MASTER PLAN OF TREES The City Council of the City of Tustin, California, dOes hereby resolve as follows: 1. The attached Master Tree Plan designating street trees for major streets is hereby adopted. adopted. 2. Variations or modifications of the provisions of this ![Resolution may be granted to a developer or subdivider to permit 17 ~ variation of the distance between trees, to change the type of trees~, or to permit the abandonment of any tree may be made upon approval :1.8 by the Development Preview Commission with the concurrence of the ~9 :[City Engineer and Maintenance Superintendent. Yreew.ells shall be located at the curb or' at the back edge of the sidewalk as approved by fao City Engineer-after consultation wi th the Tree Foreman. do Homeowners who have no parkway free may obtain a parkway free of their choice from the .approved list by payin9 the City $20.00 for'a 15-§allen tree, or the City's a~:tual cost for a larger tree. The City will plant the tree without further charge. Se Subdividers or developers shall contract with the City for planting o¢ their. · required parkway frees and pay the City's cost for the free~ all plantin9 cosfs~ 'labor~ overhead, and one year's maintenance. If approved by the City Engineer, they may install the frees directly in accordance wi'th the City's specifications, subject to City inspections, and pay the one-year maintenance fee. The charge for the s.fandard 'ID-gallon free~ plantin9, and maintenance shall be $.50.00 per free. The charge for one-year main- tenance alone for a standard'IS--gallon .free shall be $20.00. · Remova I a. The City will remove and replace as the budget permits: (I) Dead trees (unless killed through fault of a known party). (5] Trees having undesirable growth characteristics and which are causing sidewalk or curb dama'ge. . · The City may~ af ifs discretion, remove (or permit removal by the property-. owner) and replace any tree having undesirable growth characteristics although not presently causing sidewalk or curb damage. .. · .A property owner may retain a free in the category of "a (.5)" or "b" above, unless said tree is creating a real and immediate hazard, by entering info an agreement with the City accepting all liability caused by the free and all costs ct~ roof pruning, repairing sidewalk and curbing, and o~her directly related City costs of retaining said tree. No agree- menf shall be'required until and unles§ the City is actually prepared to remove the tree i n quest ion. The City will remove unauthorized or nonapproved frees not o¢ a definite problem species only upon the request of a property.owner. Removal and replacement with an authorized species will be conditione'd upon fha. property owner's purchase of a new free in accordance with paragraph Ici above.
