Home My WebLink AboutCC RES 73-3290 6 10 I1 ~4 19 ~0 as follows: RESOLUTION NO. 73-32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, FINDING AND DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE, AND ORDERING, THE ACQUISITION BY CONDEMNATION OF CERTAIN PROPERTY FOR PUBLIC PURPOSES. The City .Council of the City of Tustin hereby resolves 1. The City Council finds and determines that public interest and necessity require the acquisition by the City o~ Tustin of a perpetual easement and right-of-way for street and highway purposes, in, on, under, over, through and across that certain property located in the City of Tustin, County of Orange, State of California, more particularly described in Exhibit "A" attached hereto and incorporated herein by this reference as .~ though set forth herein in full, ~or a public purpose, namely, for public street and highway purposes and for such other public uses as may be authorized by law. The aforesaid property is a part of a larger parcel which is more particularly described in Exhibit "B" attached hereto and incorporated herein by this reference as though set forth herein in. full. The acquisition of the aforesaid interest in real property is necessary for the widening of Firs= Street in the City of Tustin. The location and general route of said street and highway is, insofar, as involved in this pro- ceeding, as shown on Maps attached hereto and by this re~e~ence made a part 'hereof ~ marked Exhibit C 2. The City Council finds and determines that the said property is necessary for such public use. 3. The City Council finds and determines that such proposed public improvement and use will be located in a manner which is most compatible with the greatest public good and the. leas.t private injury. ~4 ~5 ~? ~8 4. The City Council hereby authorizes and directs . the City Attorney, James G. Rourke, to institute eminent domain. proceedings in the Superior Court of the State of California, for the County of Orange, for the purpose of acquiring a perpetual easement and right-of-way 'for street and highway purposes in, on, under, over, through and across the aforedescribed property, for the public uses hereinabove described and to obtain immediate possession of said easement and. right-of-way. · PASSED AA~D ADOPTED at a regular meeting of the City · Council, held on the 16th day of April, 1973. · That portion of lots 7, 8 and 9 of· Tract No' 334, as per map recorded in Book 14, page 46 of Miscellaneous Maps, Records of Orange County, California, described as follows- " " .. Beginning at the northeasterly corner of said lot 9; thence, S. 00o03'30'' E., along the easterly line of said lot 9, a distance of '7.00 feet to the true point of bectinning of the parcel to be described; .thence, con~i~u~in~"S. 00~0~3'30'' E., along said easterly line, a distance of 126.44 feet; thence, N. 30o13'30'' W., a distance of 118.87 feet, 'to the beginning of a tangent curve, concave southwesterly and having a radius of 27.00 feet; thence, north- westerly, along the arc of said curve, through a central anglo of 60°00'00" · , an arc distance of 28 27 feet, to the point of tangency with a line 17.00 feet south of, as measured' at right angles from, and parallel with the northerly line of said lots 7, 8 and 9; thence, S. 89o46'30'' W., along sai~'" parallel line, a distance of 48.48 feet, to an angle point in said line; thence, 'S. 89o50'00.' W., a distance of 18.36 feet, to the intersection with 'the westerly line of said lot 7; thence, N. 00~°03'30" W.', along said westerly line, a distance of 10.00 feet, to the intersection with a line 7.00 feet south.of, as measured at right angles from, and parallel with the north~.rly line o'f said lots 7, 8 and 9; thence, N. 89o50'00'' E., along said parallel line, ~ a distance of 18.36 feet, to an angle point in said parallel line; thence, N. 89o46'30'' E., continuing along said parallel line, ,a distance of 131.64 feet, to the true point of beginning. · · 91 E XH I B I T "A" 92 Lots 7, 8 and 9 o~ Tract No. 334, in the City of Tustin, · County of Orange, State of California, as per map thereof' recorded in book 14, at page 46, of Mi'scellaneous Maps, records of said Orange County.
