RECOMMENDATION That the Planning Commission adopt Resolution No. 4098 determining that the location, purpose, and extent of the proposed acceptance of the dedication of an easement for flood control purposes is in conformance with the Tustin General Plan. BACKGROUND Section 65402(b) of the California Government Code (Planning and Zoning Law) requires a county to submit a request for, and obtain a general plan conformity determination from, the local planning agency prior to acquisition or disposition of real property within the planning agency's jurisdiction. Orange County Public Works is proposing to accept from Tustin Vistas partners, LLC the dedication of an easement encompassing Lot BQ of Tract 16582 for flood control purposes for the ultimate improvements to the Peters Canyon Channel improvements in the area. The Planning Commission is authorized to determine whether the location, purpose, and extent of the proposed conveyance are consistent with the General Plan. Planning Commission Report General Plan Conformity Determination July 22, 2008 Page 2 The proposed improvements to the Peters Canyon Channel are consistent with Goal 1 of the City of Tustin General Plan Public Safety Element, which is to reduce the risk to the community's inhabitants from flood hazards. The improvements are also consistent with the Storm Drainage Plan in the MCAS Tustin Specific Plan. The Planning Commission does hereby resolve as follows: The Planning Commission finds and determines as follows: A. That Orange County Public Works proposes to accept from Tustin Vistas partners, LLC the dedication of an easement encompassing Lot BQ of Tract 16582 for flood control purposes for the ultimate improvements to the Peters Canyon Channel improvements in the area. B. That the proposed improvements to the Peters Canyon Channel are consistent with Goal 1 of the City of Tustin General Plan Public Safety Element, which is to reduce the risk to the community's inhabitants from flood hazards. The improvements are also consistent with the Storm Drainage Plan in the MCAS Tustin Specific Plan. C. That California Government Code Section 65402 (b) provides that a county shall not acquire or dispose of any real property within the corporate limits of a city until the location, purpose, and extent of the project has been reported by the local planning agency as to the conformity with the applicable, adopted general plan. D. That general plan conformity determinations required by Government Code Section 65402 are not "projects" requiring environmental review pursuant to the California Environmental Quality Act. II. The Planning Commission hereby determines that that the location, purpose, and extent of the proposed acceptance of the dedication of an easement for flood control purposes is in conformance with the Tustin General Plan.
