ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO
FILE A NOTICE OF COMPLETION FOR TRAFFIC SIGNAL INSTALLATION
AT PIONEER ROAD AND PIONEER WAY (CIP NO. 4060)
SUMMARY
Construction of the traffic signal at Pioneer Road and Pioneer Way has been completed to the
satisfaction of the City Engineer and is now ready for City Council acceptance.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 01-107 accepting the installation of
the traffic signal at Pioneer Road and Pioneer Way and authorizing the recordation of the Notice
of Completion, and direct the City Clerk to'

Release the Labor and Materials Bond not sooner than thirty-five (35) days after the
date of recordation of the Notice of Completion; and
.
Release the Faithful Performance Bond not sooner than one year after the date of
recordation of the Notice of Completion.
Assuming no claims or stop notices are filed, it is further recommended that 35 days after the date
of recordation of the Notice of Completion the City Council authoriZe payment of the final 10%
retention in the amount of $12,970.91 to F. J. Johnson, Inc. This amount together with previous
payments of $116,738.18 represent 100% of the final contract cost.
FISCAL IMPACT
The final cost of construction for this project was $129,709.09. A combination of a developer
contribution and the City's FY 2001/2002 Capital Improvement Program (CIP) budget provided
sufficient funds for this project.

DISCUSSION
The approval of Tentative Tract Map No. 14396 included a condition that required the developer to
contribute $75,000.00 for the design and construction of a traffic signal at the intersection of
Pioneer Road and Pioneer Way. Pioneer Middle School is located at the southwest corner of the
subject intersection and school traffic will benefit from the traffic signal. The new traffic signal
assigns right-of-way and assists in moving vehicular and pedestrian traffic through the area,
particularly in the weekday A.M. and P.M. peak hours. The traffic signal is now complete and
ready for acceptance by the City Council.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR
TRAFFIC SIGNAL INSTALLATION AT PIONEER ROAD AND PIONEER
WAY (C.I.P. NO. 4060)
WHEREAS, F.J. Johnson, Inc. having a contract with the City of Tustin to
install the hereinafter described traffic' signal installation; and
WHEREAS, the City Engineer has duly certified to the installation
hereinafter mentioned in a manner satisfactory to the City Council of the City of
Tustin; and
'WHEREAS, the City Council finds that said contractor has completed said
installation hereinafter more particularly described in accordance with the
provisions of the contract documents and the Notice of' Completion, and
acceptance of said installation should be filed and payment of the balance due
said contract authorized .in accordance with the contract documents;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Tustin that said installation is found to be complete, and the same is hereby
accepted. Said installation is more particularly described as follows:

BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin
is hereby authorized to execute and file a Notice of Completion for the
acceptance of said installation herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the
City of Tustin held on the 19th day of November 2001.
