HUSTON, CITY MANAGER HUMAN RESOURCES DEPARTMENT APPROVE RESOLUTION AMENDING THE CITY'S CLASSIFICATION AND COMPENSATION PLANS AND APPROVE TRAINING PAY FOR CERTAIN CLASSIFICATIONS IN THE TUSTIN POLICE SUPPORT SERVICES ASSOCIATION SUMMARY: During the term of the Memorandum of Understanding between the City and the Tustin Police Support Services Association (TPSSA), the City agreed to continue discussions with TPSSA on two items. One item required the City to conduct an analysis of the classification of Property and Evidence Leadworker to determine proper internal alignment. The second item required the City to review market comparison data on how training pay is compensated in survey cities. This agenda item recommends the addition of training pay to certain eligible TPSSA employees and a one-percent (1%) increase in compensation for the classification of Property and Evidence Leadworker. RECOMMENDATION: 1. Adopt the revised class specification for the classification of Property and Evidence Technician/Property and Evidence Leadworker. 2. Adopt Resolution No. 01-109 amending the City's Classification and Compensation Plans to increase the compensation of Property and Evidence Leadworker by one percent (1%) effective at the beginning of the pay period closest to November 19, 2001. 3. Authorize the City to establish training pay for eligible employees of the TPSSA bargaining unit in an amount not to exceed $50.00 per month. FISCAL IMPACT: Less than $2,000 in FY 01/02. S:\City Council Agenda Items\Staff Report TPSSA Reopener1101 .doc BACKGROUND AND DISCUSSION' The Memorandum of Understanding (MOU) between the City and the Tustin Police Support Services Association (TPSSA) covers the period of time from January 1, 2001 to December 31,2002. During the term of this MOU the City agreed to continue discussions with TPSSA on two items. Article 26 of the MOU required the City to conduct an analysis of the classification of Property and Evidence Leadworker to determine proper internal alignment. Article 25 of the MOU required the City to review market comparison data on how training pay is compensated in survey cities. Pursuant to Article 26 of the MOU, the City conducted an analysis of the classification of Property and Evidence Leadworker. This analysis led the City to the conclusion that the position was in alignment internally and that it was paid in excess of the median of our ten City survey group. TPSSA disagreed with the City's findings and the City again reviewed its data. Giving consideration to the additional data supplied by TPSSA, and incorporating TPSSA's relevant comparable data, in the most generous methodology possible, the City can make a determination that the classification is compensated at a rate that is less than one-percent less than that of the median salaries for, in our opinion, comparable positions. Since this was an area of disagreement in previous negotiations (the salary for this position has been a subject of conflict with this unit on an ongoing basis), and TPSSA continues to disagree with our findings, staff believes it is in the best interests of all involved to recommend the salary range for this classification be increased by 1%. Should TPSSA continue to want to meet and confer over this item, staff will accommodate them. Article 25 of the MOU requires the parties to meet and review market comparison data on how training is compensated in the survey citys utilized for comparison purposes. Based On this data, and discussions with TPSSA, the parties have agreed to the following language for purposes of training pay for eligible unit employees. "Effective with the first pay period following Council adoption, employees in a non-lead classification in the Tustin Police Support Services Association (TPSSA) bargaining unit, assigned to train a Communications Officer, Police Support Specialist, Property and Evidence Technician, and/or a Police Services Officer, shall receive, in addition to their regular compensation, training pay (during the time assigned to training) at a rate of $50.00 per month (paid bi-weekly). Said training pay shall not exceed a period of twelve calendar months per trainee assigned. Assignments shall be based on operational needs. The City has the absolute discretion regarding the assignment and reassignment of employees as a trainer. Any such assignment is not vested and may be revoked at any time without cause, and without any right to challenge such action pursuant to the City's grievance or appeal procedure. This provision is not intended to exclude an employee in a lead classification from his/her responsibility to provide leadership and training without additional compensation." S:\City Council Agenda Items\Staff Report TPSSA Reopener1101 .doc Staff is recommending the Council authorize training pay for eligible unit employees pursuant to the language above. The additional costs associated with these items can be paid within the current departmental budget. As such, no budget adjustments will be necessary.
