I ! ! · 1 § 6 RESOLUTION NO. 73-26 A RESOLUTION OF TItE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ANNEXING TO THE CITY OF TUSTIN CERTAIN TERRITORY DESCRIBED HEREIN, AND DESIGNATED MITCHELL AVENUE ANNEXATION NO. 79. The C~ty Council of the City of Tustin, California, does hereby resolve as follows: 1. Pursuant to the provisions of.., the Government Code of the Stato of California, application was made to tho ....Agency Formation Commission to annex to the City of Tustin all i' that territory situate in the County of Orange, State of Californi~ ?!~,. described in Exhibit "A" attached hereto and' incorporated herein 8iI'i! by this reference as though.set forth herein in full. 2. The LoCal Agency Formation Commission, in session 9 duly assembled, on April 11, 19 73, did approve said proposed annexation and authorize the City Council to annex said ter.ritory 10 without notice, hearing or election. 11 3. All of the owners of land within the territory proposed to be annexed have given their written consent to the. 1~ annexation of sai'd territory to the City of Tustin. ..~ 15 4. The City Council des ires to annex- said territory to the City of Tustin for the following reasons: The territor-'- 14 is contiguous to the City of Tustin and its proposed annexatior. will contribute to and facilitate the orderly growth and. devel~ 15 ment of both the City and the territory proposed to be annexed, .will facilitate and contribute to the proper and orderly layout, 16 design and c6nstruction of streets, gutters, sidewalks and .sanit~ and storm-water sewers' and drainage facilities', both in the City 17 and 'in the territory proposed to be annexed, and will provide and facilitate proper over-all planning and zoning of lands in 18 said City. and in said territory, in a manner most conducive 19 to the welfare of the City and said uninhabited territory. 5. The w~i%ten consent of the owners of more than ~0 two-thirds of the value of the territory of the subject annexation has been hereto filed with the City Clerk, agreeing and con- , senting to pay indebtedness and liability of the city contracted I prior to, or existing at, the time of the annexation 6. The City Council of t~e City of Tustin does hereby approve the annexation of the territory hereinabove described to the City of Tustin, and does hereby further resolve that the ~! said territory be and it is hereby annexed to the City of Tustin, !! effective upon the date of the filing of the certified copy of this Resolution with the Secretary of State of the State of California 7. Thence, leaving said centerline of Mitchell Avenue, said southwesterly line of lot 35, Block 11 and said southwesterly boundary of Tract No. 3935, N. 40o20'47'' E., along the southeasterly boundary of said Tract No. 3935, a distance of 330.01 feet, to the most easterly corner of said Tract No. 3935, said easterly corner also being an angle point in the existing City of Tustin boundarf per above mentioned Nisson-Red Hill-Mitchell Annexation No. 72; Thence, N 40° · =u 47.
