HomeMy WebLinkAboutCC RES 73-03RESOLUTION NO. 73- 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR DEMOLITION WORK ON THE PARK SITE ON THE CORNER OF RED HILL AND BRYAN AVENUES WHEREAS, it is the intention of the City Council of the City of Tustin, California, to remove existing vegetation and structures at Red Hill/Bryan Park site, and WHEREAS, the City Engineer has presented plans and specifications for the work at this location; and, WHEREAS, the City Council has reviewed these plans and specification and determined that this project will have no significant environmental impact; NOW, THEREFORE, be it resolved that the plans and specifications presented by the City Engineer be and are hereby approved .as the plans and specifications for demolition work on the Park site on the corner of Red Hill and Bryan Avenues. BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to advertise as required by law for the receipt of sealed bids or proposals for the doing of the work specified in the aforesaid plans and specifications which said advertisement shall be substantially in the following words and figures, to wit: '. "NOTICE TO CONTRACTORS" SEALED PROPOSALS will be received at the office of the City Clerk, Tustin City Hall, 140 West Second Street, Tustin, California, until 11:00 a.m. on the 15th day of January, 1973 , at which time they wi'l~ ~e'" pubi'i'cly opened and reaa, .... ~°r performing work-as follows: In the City of Tustin, demolition work on the Park site on the corner of Red Hill and Bryan Avenues shall be performed by the Contractor all in accordance with the plans and specifications Plans, specifications, and proposal forms to be used for bidding on this project can only be obtained at the Tustin City Hall, Tustin, California. .. In conformance with Section 37931 of the Government Code, all bids shall be presented under sealed cover on the proposal form provided and accompanied by one of the following forms of bidder's security: · a) Cash b) Cashier's check made payable to the City of Tustin c) Certified check made payable to the City of Tustin d) Bidder's bond executed by an accredited surety insurer, made payable to the City of Tustin The security shall be in an amount equal to at least ten percent (10%) of the amount of the bid. A bid shall not be considered unless one of the forms of bidder's security is enclosed therewith. ' A-! A surety bond of an insurance company rated A+AA or better for payment of labor and materials will be required in the amount of fifty percent (50%) of the estimated total contract price and a Faithful Performance Bond in the amount of one hundred percent (100%) of the estimated total contract price in the form attached to the contract documents. City of Tustin reserves the right to reject any or all bids, and/or waive any informality on a bid. No bidder may withdraw his bid for a period of thirty (30) days after the date set for the opening thereof. The contract will be awarded to the lowest qualified bidder based on the total price of the project. Provisions of ~he State Contract Act are not applicable, and prospective bidders will not be required to be prequalified. Ail work to be done under the direct supervision of ~he City Engineer, Parks & Recreation Director, City of Tustin, or his authorized representative, Richard Bigler Associates, Landscape Architect. Said City of Tustin, pursuant to the Labor Code of the State of California, has ascertained and determined that the general prevailing rate of hourly and per diem wages in the locality in which the said work herein described is to be performed, for each craft or type of workman or mechanic needed to execute the contract and also the general prevailing rate for legal holidays and overtime work for each craft or type of workman or mechanic, to be as indicated in Resolution 70-42 as previously published in a newspaper of general circulation, and on file in the office of the City Clerk. ' Employer payments other than those itemized therein, as defined in Section 1773.1 of the Labor Code, are to be paid in accordance with the terms of the collective bargaining agreement applicable to the type or classification of the workmen or mechanics employed on the project. C6pies of all collective bargaining agreements relating to the work as set forth in the aforementioned Labor Code are on file and available for inspection in the office of the Department of Industrial Relations, Division of Labor Statistics and Research.
