HomeMy WebLinkAboutCC RES 72-72RESOLUTION NO. 72- 72 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN ESTABLISHING A CITY WATER SYSTEM THE CITY COUNCIL OF THE CITY OF TUSTIN DOES RESOLVE AS FOLLOWS: . Section 1. Definitions. (a) "City" shall mean the City of Tustin, a municipal corporation of the State of California, in its present in- corporated form or in any later reorganized, consolidated, enlarged or re-incorporated form. (b) "City water system" shall mean the uniform system of water supply provided by the City of Tustin or its designate, as provided in this resolution. (c) "Person" shall mean any natural person, partner- ship, unincorporated association or public or private corpora- tion. Sec%ion 2. Water Supply. · · , All~ water service in the city shall be provided from the city water system only. _ Section 3. Supplier. All water service in the city shall be supplied from water facilities owned and operated by the city; provided, however, that if the city shall at any time not own and operate water facilities sufficient to serve any area of the city, the city council may, by resolution, designate any other person to supply water to any area that cannot be served by water facilities owned and operated by the city. Section 4. Severability. · If any section, subsection, sentence, clause or phrase of this resolution is for any.reason held illegal, in- valid or unconstitutional by the decision of .any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this resolution.
