HomeMy WebLinkAboutCC RES 72-66RESOLUTION NO. 72-66 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ORDERING THE SUPERINTENDENT OF STREETS TO PROCEED WITH THE CONSTRUCTION OF STREET IMPROVEMENTS UNDER THE PROVISIONS OF CHAPTER 27 OF THE "IMPROVEMENT ACT OF 1911" (CHAPTER 27 , PROJECT 72-4) WHEREAS, the City Council of the City of Tustin, California, ~' did adopt Resolution No. 72-10 directing the Superintendent of Streets to proceed with the steps necessary to have street 8 improvements constructed benefiting the property abutting Laguna Road from approximately 84 to 284 feet easterly of 9 Newport Avenue pursuant to the provisions of Chapter 27 of the "Improvement Act of 1911," being part 3 of Division 7 10 of the Streets and Highways Code' of the State of California; and, 11 WHEREAS, the Superintendent of 'Streets did on the 21st 1~ day of September, 1972, .give notice to construct said street improvements to the owners or persons in possession of the 15 individual properties in-said locations in the manner and form prescribed in Sections 5876 through 5879, inclusive, of 141. the said Code, said notices also setting forth a time and place for hearing thereon; and, WHEREAS, a hearing was duly held pursuant to Section 16 5878.1 of the said Code on the day and hour specified in the sa~'d notices, and all objections or protests were overruled 17 and denied by this Council; 18 19' 21 . . NOW, THEREFORE', BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TUSTIN, C~IFORNIA, AS FOLLOWS: Section 1. That the said City Council hereby determines and declares that the work and improvement heretofore mentioned is of public benefit and necessity and that the public interest and convenience require that the work be done, and that the property where notice was given will be benefited to the extent of the 'improvements proposed thereon. 24 ~6 ~7 Section 2. That the Superintendent of Streets be and is hereby ordered to proceed immediately with the construction of the said improvements inasmuch as the petition presented by said property owner expressly waived the 60-day Period for commencing the construction.
