AGENDA REPORT MEETING DATE: AUGUST 5, 2008 TO: WILLIAM A. HUSTON, CITY MANAGER FROM: SCOTT M. JORDAN, CHIEF OF POLICE SUBJECT: POLICE DEPARTMENT VEHICLE PURCHASES SUMMARY Purchase four (4) 2008 Dodge Charger police package vehicles to replace older model high mileage vehicles. Award contract for police equipment conversion work for newly purchased police units. RECOMMENDATION It is recommended that the City Council approve the purchase of: 1. Four (4) 2008 Police Package Dodge Chargers from McPeek's Dodge of Anaheim, California in the amount of $98,669.35 (Including tax, license, and delivery). 2. Police equipment conversion packages for the conversion of four (4) 2008 Police Package Dodge Chargers from North Star Electronics in Downey, California in the amount of $43,254.26. The total conversion cost includes the purchase and installation of safety lighting system to equip ten (10) of our existing Dodge Charger patrol vehicles due to officer safety and visibility issues. FISCAL IMPACT Adequate funds are currently available in account #84-801-9730 (Vehicle Equipment Lease and Replacement Fund) in the amount of $141,923.61. Police Department Vehicle Purchases August 5, 2008 Page 2 of 4 BACKGROUND In fiscal year 2008/2009, it is necessary to replace the above listed vehicles due to age, mileage and/or safety history. A breakdown of each vehicle replacement is as follows: Marked Police Unit 3403, 3404, 3413, and 3423 are scheduled for replacement due to high mileage and scheduled rotation. We intend to replace these four older model Ford Crown Victorias with 2008 Dodge Chargers as we continue to transition the police fleet to the Dodge vehicles. Our first generation of Dodge Chargers outperforms any other police package vehicle on the market today, and we continue to appreciate the safety features the Dodge Charger offers specific to law enforcement applications. Dodge Vehicle Purchases: Due to State Contract date scheduling realignment, staff could not provide State Contract pricing information for a Police Package Vehicle. Staff was able to contact Marc Anderson, Contract Administrator for the Department of General Services Procurement Division, who advised that we will not see a new contract until the fall of 2008. Waiting for the new contract, vehicle delivery, and conversion time would delay the new patrol vehicle deployment into spring 2009. During our dealership quote request process for 2008 Police Package Dodge Chargers, we found that the only local dealership with the 2008 model still available was McPeek's Dodge of Anaheim. The other various dealerships were able to provide a projected quote for 2009 Dodge Chargers and are expected to have the vehicles late October 2008. After contacting McPeek's Dodge and confirming they have sufficient units in stock, we were able to get vehicle pricing and piggyback off of Alameda County's vehicle purchase contract. (Refer to Appendix "L" City of Tustin Informal bid Process.) Alameda County's three quote competitive bid process for purchases under $100,000 is comparable to Tustin's bid process. For purposes of this contract, Alameda County completed further extensive research which included a written question due date, bidder's conference, addendum date, response due date, response review date, award notification, and a contract start date. Each step was publicly advertized through local newspapers and their county website. (Refer to Appendix "L" City of Tustin Informal bid Process.) After reviewing price comparisons and vendor stock supply, we are confident McPeek's Dodge of Anaheim can provide pricing that is less than last year's state contract dollar amount; and it will be significantly less than the 2009 Police Package Dodge Charger. (Refer to Appendix "C" City of Tustin Informal bid Process.) Police Department Vehicle Purchases August 5, 2008 Page 3 of 4 Staff contacted Kevin Draucker, Fleet and Leasing Director at our local Tustin Dodge dealership for a quote requested. Mr. Draucker advised they were all out of the 2008 Police Package Dodge Charger and currently did not have pricing for the 2009 model. Purchase of Police Equipment Conversion Services: In pricing conversion services, it is important to note that, while there are a number of vendors available in a tri-state area including Nevada and Arizona, proximity to the Police Department is a major factor in the decision making. The proximity factor is significant with regards to transporting the vehicles to and from the vendor's facility and in the oversight of the conversion process. Since all police agencies operate under slightly different conversion specifications, it is the duty of the fleet coordinator to oversee the conversion process by inspecting the vehicle at various stages of development (i.e. wiring schematics, equipment mounting devices and location, etc.) With this oversight, the coordinator makes multiple personal trips to .and from the conversion vendor's location, and is also responsible for scheduling necessary personnel to deliver and pick-up vehicles from the vendor's facility. With these factors, we are limited to the selection of a vendor within a 100 mile radius of the Police Department, as any further distance would be counterproductive, staff time and personnel intensive, and costly. (Refer to Appendix "G" through "I" City of Tustin Informal bid Process.) The second consideration for a conversion vendor is the size of their operation. The size of the operation directly correlates to the amount of time the conversion process will take. Smaller operations with fewer employees will obviously require a longer processing period than those larger companies with more available manpower. Conversions can take anywhere from one week to three months to complete. The longer processing period requires more time from the fleet coordinator and delays the availability of the vehicle. During the implementation of our first generation 2006 Dodge Charger police patrol vehicles, specific safety emergency lighting was not available for such a new vehicle model. Now, such an adapter and safety lighting system is available and needed for vehicle visibility which insures officer safety. When our Dodge Charger patrol vehicles are in the parked position with the trunk open, the light bar visibility is obstructed from the rear of the vehicle. This obstruction makes traffic stops, traffic collision investigations, and other field work related to traffic control an officer safety issue. We currently have ten (10) patrol vehicles which need this modified lighting system. (Refer to Appendix "J" City of Tustin Informal bid Process.) With these considerations in mind, staff solicited bids from all vendors within a feasible proximity to the Police Department and with sufficient staff to process the vehicles within Police Department Vehicle Purchases August 5, 2008 Page 4 of 4 a reasonable time frame. The County is vitally interested in promoting the growth of small and emerging local businesses by means of increasing the participation of these businesses in the County's purchase of goods anal services. Potential candidates referred by County to Contractor will be pre-screened, qualified applicants based on Contractor's specifications. The system was designed to help reduce contractors' administrative costs and to provide various work-flow automation features that improve the project reporting process. Effective July 1, 2007, the Alameda County Contract Compliance System will be implemented to monitor contract compliance for Caunty contracts through the use of a new interactive website, Elation Systems. The prime contractor and all participating subcontf~actors awarded contracts as of July 1, 2007, as a result of this bid process far this project, are required to use the secure web-based system to submit SLEB Program information including, but not limited to, monthly progress payment reports and other information related to SLEB participation. The Alameda County cantract Compliance System has been designed to provide online functionality that streamlines the process, reduces paperwork and assists contractors and subcontractors in complying with the County"s SLEB Program and its reporting requirements. Utilizing the Alameda County Contract Compliance System will reduce the amount df time currently required to submit hard copy documentation regarding contract compliance information and is provided for use by Caunty contractors and subcontractors at no cost. Evidence of Insurance Certificates of insurance are required per the attached Exhibit C from a reputable insurer evidencing all coverage required for the term of any contract that may be awarded pursuant to this RFQ. The County's insurance requirements for Additional Insured reads, "All insurance required above with the exception... shall be endorsed to name as additional insured...." An endorsement is an amendment to a contract, such as an insurance policy, by which the original terms are changed. The insurance certificate (also known as the "ACOIZD") carries a disclaimer, "This certificate is issued as a matter of information only and confers no rights upon the certificate holder. This certificate does not amend, extend or alter the coverage afforded by the policy below." Additional insured listed in the description box is not a proper risk transfer. Any amendment or extension of the coverage such as an additional insured should be provided by a separate endorsement page or copy of the policy. NAKAC7, Director The Alameda County GSA MVD maintains a fleet of law enforcement, transportation and service vehicles at various locations throughout the County. MVD will purchase the aforementioned automobiles to be used as scheduled replacement vehicles for a portion of it's fleet of law enforcement and non law enforcement vehicles. These vehicles will be used on a daily basis by law enforcement personel and county staff to carry out their duties in various areas throughout the County SELECTION CRITERIA/PROCESS: In each case a Request for Interest (RFI) was mailed to six hundred twenty-one (621) vendors on the County's SLEB database. Of the (621) vendors one hundred seventy-three (173) were local under the category of new car dealers. 1) Purchasing received eight (8) responses to each the Ford RFI's. The same vendors responded to both the Crown Victoria Bid and the Ford Focus bid. A Request for Quotation was mailed to the eight (8) prospective bidders. Bid conferences were advertised and held but were not attended by any prospective vendors. Outreach was done with the hope of creating interest but many dealerships are no longer interested in government fleet business. One qualified bid was received on the due date from Broadway Ford. 2) Purchasing received six (6) responses to the Chevrolet Impala RFI. A Request for Quotation was mailed to the six (6) prospective bidders. 3) Purchasing received four (4) responses to each the Dodge RFI's. The same vendors responded to both the Dodge Caravan Bid and the Dodge Charger bid. A Request for Quotation was mailed to the four (4) prospective bidders. Broadway Ford of Oakland and Hayward Ford, both local vendors, submitted complete bid packages. Neither vendor qualifies for SLEB certification because the dealerships exceed the SBA standards for a small business. A Request for Authorization to use anon-SLEB local vendor has been approved by the Business Outreach & Compliance Office (BOCO).
