RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA , APPROVING PLANS AND
SPECIFICATIONS FOR THE CONSTRUCTION OF STREET
IMPROVEMENTS.
PROJECT I - NORTH~ST CORNER OF LAGUNA RD.

PROJECT II - NORTH SIDE OF LAGUNA RD. EAST
OF NEWPORT AVE.
PROJECT III - SOUTH SIDE OF LAGUNA RD. WEST
· OF NEWPORT AVE.
WHEREAS, it is the intention of the City Council of the
City of Tustin, California, to construct certain street improve-
ments on Laguna Road between E1 Camino Real and Orange Street
and on Newport Avenue north of Laguna Road, and;
WHEREAS, the City Engineer has presented plans and specifications
for the construction of said work at this location,
presented by the City Engineer be and are hereby approved as the
plans and specifications for the construction of street improve-
ments on Laguna Road between E1 Camino Real and Orange Street
and on Newport Avenue north of Laguna Road, and;
NOW, THEP£FORE, be it resolved that the plans and specifications.
BE IT FURTHER RESOLVED that the City Clerk is hereby
authorized and directed to advertise as required by law for the
· receipt of sealed bids or proposals for the doing of the work
specified in the aforesai.d plans and specifications which said
advertisement shall be substantially in the following words and
figures, to-wit:.

SEkLED PROPOSALS will be received at the office of the City'
Clerk, Tustin City Hall, 140 West 2nd Street, Tustin, California,
until !1 o'clock A.M. on the Second day of October, 1972, at which
time they will be publicly opened and read, fbr performing work
as follow:
In the City of Tustin, street improvements on Laguna Road
between E1 Camino Real and Orange Street and on Newport Avenue
north of Laguna Road. ~

:. ' The foregoing quantities are approximate only, 'being. given as
- basis for the comparison of bids, and the City of Tustin does not,
expressly or by implication, agree that the actual amount of work will
· correspond therewith, but reserves the right to increase or decrease
~the amount of any class or portion of the work, or to omit portions
of the work as may be deemed necessary or advisable and in ~.e best
interest of the. City by the Engineer.
Plans, specifications, and proposal forms to be used for bidding
on this pro.ject can only be obtained at the Tustin City Hall., Tustin,
California.
In conformance with Secti'on 37931 of the Government Code, all' bids
shall be presented under sealed cover on the proposal, form provided and
accompanied by one of the following forms of bidder's security:
a. Cash
b. Cashier's Check made payable, to the City of Tustin
c. Certified check made payable to the City of Tustin
d. Bidder's bond executed by an accredited surety insurer,
made payable to the City of Tustin
The security shall be in an amount equal to at least ten percent
(10%) of the amount of the bid. A bid shall not be considered unless
one of the forms of bidder's security is enclosed therewith.
A Surety Bond for payment of labor and materials will be required
in the amount of fifty percent (50%) of the estimated total contract
~--price and a Faithful Performance Bond in the amount of one hundred
percent (100%) of the estimated total contract price in the form
attached to the contract documents. Said bonds shall be issued by
a company having a rating of A+AA or better.
City of Tustin reserves the right to reject any or all bids, and/
or waive any.~ informality on a bid. No bidder may withdraw his bid for
a period of thirty (30) days after the date set for the opening thereof.
The contract will be awarded' to the lowest qualified bidder based
on the total price of Project.I, Project II, and Project III.
Provisions of the State Contract Act are not applicable, and
prospective bidders will not be required to be prequalified.

Ail work to be done under the direct supervision of the City
Engin'~er, City of Tustin.
All work to be paid for at the unit prices bid from appropriate
monies.
Said City of Tustin, pursuant to the Labor Code of the State of
California, has ascertained and determined that the general prevailing
rate' of 'hourly and per diem wages in the locali[y in which the said
,.,work herein described is to be performed, for each craft or type of
workman or mechanic needed to execute the contract and also the general
prevailing rate for legal holidays and overtime work for each craft
or type of workman or mechanic~ to be as indicated in Resolution 70-42
as previously published in a newspaper of general circulation, and on
file in the office of the City Clerk.

Employer payments other than those itemized therein, as defined
in Section '1'773.1 of ~the Labor Codo, are to be paid in accordance with
.the terms of the collective bargaining agreement .~pplicable to %he
:.'~ ~-~ chanics employed on the
type or 'clasSification of the workmen .:~. me
project.

Copies of all collective .bargaining agreements' relating t6 the work
as set. forth in the aforemontioned Labor Code are on file and available
for inspection in %he office of ~he Department of Industrial. Relations,
Division of Labor Statistics and Research. ·

BE IT ALSO RESOLVED that the City Council' of the City. of Tustin
has ascertained and does hereby determine that the general prevailing
rate of wages and employer payments in the locality of' the Ci%y of
Tustin, California, for each craft or type of workman needed to execute
the work herein above specified is as set forth in Resolution 70-42.
