RESOLUTION NO. 72-58
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TUSTIN, CALAIFORNIA, ORDERING
THE SUPERINTENDENT OF STREETS TO PROCEED
WITH THE CONSTRUCTION OF MISSING IMPROVE-
MENTS UNDER THE PROVISIONS OF CHAPTER 27
OF THE IMPROVEMENT ACT OF 1911" (PROJECT
72-6).
Division 7 of the Streets and Highways Code of the State of
California; and,
·
WHEREAS, the Superin'tendent of Streets did on the 22nd day
of August, 1972, give no%ice to construct missing improvements
to the owners or persons in possession of the individual
properties-in said locations in the manner and form prescribed
in Sections 5876 through 5879, inclusive, of said Code, said
notices also setting forth a time and place for hearing
thereon; and,
WHEREAS, the Superintendent of Streets has submitted to
this Council a list showing the location or description of.
each individual property for which a notice to construct
improvements was given and what improvement is required; and,
WHEREAS, a hearing was duly held pursuant to Section 5878.1
of said Code on the day and hour specified in said notices,
and ali. objections or protests were overruled and 'denied by
this Council;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY coUNcIL OF THE
CITY OF TUSTIN, CALIFORNIA, AS FOLLOWS' ·
SECTION 1. That said City Council hereby determines and
declares that the work and improvement heretofore mentioned
is of public benefit and necessity and that the public interest
and convenience requiore· that the work be done, and that each
of the properties where notice was given will be benefited
to the extent of the improvements proposed thereon.
SECTION 2. That the Superintendent of Streets be ordered
to proceed with the construction of the missing improvements
indicated at the locations shown on the list attached hereto,
marked "Exhibit A," if not done so by the property·owners
within sixty days from the said date of posting of the "Notice
to Construct."
PASSED 7LND ADOPTED at a regular meeting of the City. Council
of the City of Tustin California, held on the 5th
day of September , 19 72.
