HomeMy WebLinkAboutCC RES 72-36 RESOLUTION NO. 72- 36 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, FINDING AND DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE, AND ORDERING, THE ACQUISITION BY CONDEMNATION OF CERTAIN PROPERTY FOR PUBLIC PURPOSES. The city Council of the City of Tustin hereby resolves 6 as follows.- . 1. The City Council finds and determines that public interest and necessity require the acquisition by the City of 8 Tustin of that certain property located in the City of Tustin, County of Orange, State of California, more particularly described 9 in Exhibit "A" attached hereto and incorporated herein by this reference as though set forth herein in full, for a public purpose, 10 namely, for public road, street, highway and public utility pur- poses, and for such other public uses as may be authorized by law, ll,i and for immediate possession thereof. 12 t! 2. The City Council finds and determines that the said ii property is necessary for such public use. 3. The City Council finds and determines that such 14 proposed public improvement and use will be located in a manner which is most compatible with the greatest public good and the 15 least private injury. That the proposed public use is a more necessary public use than the public uses which the said property 16 presently serves. 4. The City Council hereby authorizes and directs the City Attorney, James G. Rourke, to .institute eminent domain pro- ].8 ceedings 'tn the-Superior C~urt of the State of California for the County of Orange for the purpose of acquiring an easement, for a J.9 public street, and highway, and 'all right, title and interest in ~. and to said property necessary for such public use, and for immedi- 20 ate possession thereof.
