CALL TO ORDER MEETING #2179 AT 8:31 A.M.
ATTENDANCE
Present: Mayor Jerry Amante; Mayor Pro Tem Doug Davert; and
Councilmembers Lou Bone; Tony Kawashima; and Jim Palmer
Absent: None

JOINT ITEM OF THE CITY COUNCIL AND
TUSTIN PUBLIC FINANCING AUTHORITY
1. TUSTIN LEGACY COMMUNITY PARTNERS, LLC (TLCP) WAIVER REQUEST OF
CERTAIN PROVISIONS OF THE DISPOSITION AND DEVELOPMENT
AGREEMENT (MASTER DEVELOPMENT) BETWEEN THE CITY OF TUSTIN,
TUSTIN PUBLIC FINANCING AUTHORITY AND TLCP AND REQUESTING
CONCURRENCE ON PROPOSED HOTEL PRODUCTS WITHIN
NEIGHBORHOOD D OF THE TUSTIN LEGACY PROJECT
A request has been received from TLCP for the City to waive provisions of Section
8.7.4 of the Disposition and Development Agreement (Master Developer) between
the City and TLCP to permit Vertical Builders to enter into binding sale and rental
agreements prior to Master Association Documents being in place and prior to
approval of an applicable Sector B Final Map.
Christine Shingleton, Assistant City Manager, reported that TLCP has requested a
waiver of certain provisions of DDA, but due to the fact that there have been a
number of technical issues related to this matter the Developer has requested this
item be continued.
Motion: It was moved by Mayor Pro Tem Davert, seconded by Councilmember
Bone, to continue consideration of matter. Motion carried 5-0.

Government Code Section 54956.9(a) - Sema Construction Inc. v. City of Tustin,
Case No. 00101147
RECESS to Closed Session at 8:33 a.m. and RECONVENED with all members present at
8:35 a.m.
CLOSED SESSION REPORT -City Attorney reported that by unanimous consent the City
Council authorized the City Attorney to file cross complaint lawsuit that will be made available
in the City Clerk's Office as soon as it is filed.
