THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DOES ... HEREBY RESOLVE AS FOLLOWS: WHEREAS, a public hearing was called for March 6, 1972, at the hour of 7:30 P.M. in the Council Chambers of the City o.f Tustin, California, to ascertain whether the. public necessity, health, safe%y, or welfare requires the removal of poles, overhead wires and associated structure and the underground installation of wires and facilities for Supplying electrical, communication, or similar or associated service, within that certain area of the CitY of Tustin described as follows: That portion of Lots 62 and 63, Block 11, of Irvine's Subdivision, as per map recorded in Book 1, Page 88 of Miscellaneous Maps, records of Orange County, California, described as follows: The southeasterly 50.00 feet of said Lot 63 and the northwesterly 50.00 feet of said Lot 62. Excepting therefrom the southwesterly 150.00 feet and the northeasterly 40.00 feet; .and WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and time required by law; and WHEREAS, such hearing has been duly and regularly held and all persons interested have been given an opportunity to be heard. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Tustin that pursuant to Ordinance'No. 411 of the City of Tustin the above described area is hereby declared an Underground Utility District and is designated as Underground Utility District No..1 of the City of Tustin. Attached hereto marked Exhibit "A" and hereby incorporated as a part of this resolution, is a map delineating the boundaries of said District; RESOLVED FURTHER, that the Council does hereby fix August ' 15, 1972, as the date by which affected property owners must be ready to receive underground service, and does hereby order the removal of all poles, overhead wires, and associated overhead structures, and the underground installation of wires and facilities for supplying electrical, communication, or similar or associated service within Underground Utility District No. 1 on or before September 1, 1972. . RESOLVED FURTHER, that th'e following exception in said Underground Utility District No. 1 be and they are hereby .... .... aut~bri zed: · 4 8 l0 14 20 24 Z8 ~0 (1) Any municipal facilities or equipment installed under the supervision and to the satisfaction of the City Engineer. (2) Poles or electroliers used exclusively for street lighting (or traffic signals). · (3) Overhead wires (exclusive of supporting structures) crossing any portion 'of a District within which overhead wires have been pro- hibited, or connecting to building on the perime.ter of a District, when such wires originate in an area from which poles, over- head. wires and associated overhead structures are not prohibited. (4) Poles, overhead wires, and associated overhead structures used for the transmission of electric energy at nominal voltages in excess of 34,500 volts. (5) Antennae, associated equipment and supporting structures, used by a utility for furnishing communication services. (6) Equipment appurtenant to underground facilities, such as surface mounted transformers, pedestal mounted terminal boxes and meter cabinets, and concealed ducts. · (7) Temporary poles, overhead wires and associated overhead structures used or to be .used in conjunction with construction projects. , RESOLVED FURTHER, that the City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within Underground Utility District No. 1 of the adoption of this resolution within ten (10) days after the da~e of such adoption. Said CitY Clerk shall further notify said property owners of the necessity that, if they or any person occupying such property desires to continue to receive electric, communication or other similar or associated service, they or such occupant shall, by the date fixed in this resolution, provide all necessary facility changes on their premises so as to receive such service from the lines of the supplying utilitY or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective· utility or utilities on file with the Public Utilities Commission of the State of California'. Such notification shall be made by mailing a copy of this resolution together with a copy of said Ordinance No. 411 and a statement that the City Engineer's report containing details of the District is available for inspection by the public in the Office of the City Clerk, to all affected property owners as such are shown on the last equalized assessment roll and to the affected utilities; RESOLVED FURTHER, that the Council hereby finds and determines as follows: ' 4 .7 8 l0 11 15 1'6 18 The..UndergroUnd 'Ut~'~'llty Distri'Ct'.herein created is in the general public interest'" for the following reasons: (1) The .streets, roads, or rights of way in the "District are extensively used by the general public and carry a heavy volume of pedestrian or vehicular traffic. (2) Such undergrounding will avoid or eliminate an unusually heavy concentration of over- head distribution facilities. .
