HomeMy WebLinkAboutCC RES 71-79'4 8 9 l0 19 ~0 50 RESOLUTION NO. 71-79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, ANNEXING TO THE CITY OF TUSTIN CERTAIN TERRITORY DESCRIBED HEREIN, AND DESIGNATED U. S. MARINE CORPS - IRVINE ANNEXATION NO. 71-A The City Council of the City of Tustin, California, does 'hereby resolve as follows: 1. Pursuant to the provisions of the Government Code of the State of California, application was made to the Local 'Agency Formation Commission to annex to the City. of Tustin all that territory situated in the County of Orange, State of California described in Exhibit "A" attached hereto and incorporated herein by this referen.ce as though set forth herein in full. 2. The Local Agency Formation Commission, in session duly assembled, on May 26, 1971, did approve said proposed annexation. ~' ' 3. Ail of the owners of land within the territory proposed to be annexed have given their written consent to the annexation of said territory to. the City of Tustin. 4. The City Council desires to annex said territory to the City of Tustin for' the following reasons: The territory is contiguous to the City of Tustin and its proposed annexation will contribute to and facilitate the order, ly growth and develop, ment of both the City and the territory proposed to be annexed, will facilitate and contribute to the proper and orderly layout, design and construction of streets, gutters, sidewalks and sanitary and storm-water sewers and drainage facilities, both in the City and in the territory proposed to be annexed, and will provide and facilitate proper over-all plannin~ and zoning of lands in said City and in said territory, in a manner most con- ducive to the welfare of the City and said uninhabited territory. 5. The written consent of the owners of more than two-thirds of the value of the territory of the subject annexation has been here to fi led wi th the City Clerk, agreeing and consenting that the property within the annexed territory shall be taxed to pay indebtedness and liability of the City contracted prior to, or existing at, the time of the annexation. 6. The City Council of the City of Tustin does hereby approve the annexation of the territory hereinabove described to the City of Tustin, and does hereby further resolve that~ the said territory be and it is hereby annexed to the City of Tustin, effective upon the date of the filing of the certified copy of this Resolution with the Secretary of State of the State of California. 7.. The property within the annexed territory shall be taxed to pay the indebtedness and liability of the City contracted prior to or existing at the time of annexation. 4 8 ~0 12 15 16 19 ~0 ~9 50 8. The City Clerk of the City of Tustin is hereby directed without delay to transmit to the Secretary of State of the State of California a certified copy of this Resolution. Slock 45, of said Irvine's Subdivision, said northeasterly line also being the centerline of the Santa Ana Freeway; Thence, N. 50o06'30'' W., along the northeasterly lines of Lots 40, 39, 38 and 37, Block 45, of said Irvine's Subdivision, and along said centerline of the Santa Ana Freeway, a distance of 3,500 feet more or less to the intersection of the northwesterly line of that 60 foot wide strip of -' land described in a deed to the Atchison, Topeka and Santa Fe Railroad .~-Company, recorded in Book 258, Page 383 of .Deeds, Records of said Orange Co un ty; · Thence, S. 39°56'00" W., along said northwesterly line, a distance of 90 'feet more or less to .an angle point in the existing boundary of the City of Tustin, as established by the Browning Avenue-Walnut Avenue Annexation, per Ordinance No. 404, passed and adopted June 17, 1968; Thence, continuing S. 39°56'00" W., along said City boundary and along said northwesterly line, a distance of 2,548 feet more or less, to the most southerly corner of said annexation, said southerly corner also being a point on the southwesterly line of Lot 44, Block 45, of said Irvine's Subdivision and being the most easterly corner of the Red Hill-Walnut Annexation to the City of Tustin, California, per Ordinance No. 343, passed and adopted March 20, 1967; Thence, S. 39o53'00" W., along said City of Tustin boundary, as established by last mentioned annexation and along said northwesterly line, a distance of 1,880 feet more or less, to the beginning of a tangent curve, concave easterly and having a radius of 794.49 feet; (. Thence, along the arc' of said curve, through a central angle of 64o15 ' 00" . , a distance of 890 92 feet to the most southerly corner of last mentioned annexation, said southerly corner also being a point on the north- easterly right-of-way of the Atchison, Topeka and Santa Fe Railway Company (100' wide) first described above; Thence, leaving said City boundary, S. 49o20'40'' E., along said northeasterly.railroad right-of-way line, a distance of 4646.80 feet to "'"the true point of beginning.
