HomeMy WebLinkAboutCC RES 71-764 6 8 1..0 :1.1 :1.3 :1.4 :!.5 :!.6 :1.7 :1,.8 :1.9 ,9,0 21 ,9,5 ,9,4 ,9,5 28 ~9 ~0 ;51 RESOLUTION NO. 71-76 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DETERMINING THAT PAYMENT OF CERTAIN ASSESSMENTS FOR WORK PERFORMED PURSUANT TO PROVISIONS OF CHAPTER 27 OF THE IMPROVEMENT ACT OF 1911, MAY BE MADE IN 10 ANNUAL INSTALLMENTS AND DETERMINING THAT NO INTEREST SHALL BE PAID TO THE CITY ON ANY UNPAID BALANCE, AND DIRECTING THE CITY TREASURER TO BILL AND COLLECT SUCH PAY- MENTS (Ch. 27, Project 71-1) WHEREAS, the Superintendent of Streets of the City of Tustin did cause the construction of certain drainage improvements to be done pursuant to provisions of Chapter 27 of Part 3 of Di- vision 7 of the Streets and Highways Code of the State of California and in accordance with Resolution No. 71-60 of the Council of the. City.of Tustin and thereafter in accordance with provisions of Section 5882 of said Code, he did on the 4th 'day of November, 1971, file with the City Clerk a Report for the City Council specifying the assessment against each lot proposed to be levied to pay the cost of such improvements; and, WHEREAS, the said Superintendent of Streets did give Notice 'of the Costs of construction in the manner and form pre- scribed in Sections 5877, 5878 and 5881 of the said Code, and did also mail or deliver with each Notice a letter describing the alternate methods by which a property owner could pay the assessment and giving each property owner a description of alternate methods of payment available; and, WHEREAS, the owners of certain properties proposed to be assessed have, in their petition, stated a preference for making payment of the assessments in annual installments, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AS FOLLOWS: · 'SECTION 1: Pursuant to Section 5895 of the Streets and HighWays Code of the State of California, that payment of assessment costs hereafter levied against the properties as described in the REPORT OF THE SUPERINTENDENT OF STREETS (Chapter 27, Project 71-1) as filed in the office of the City Clerk on November 4, 1971, may be made in ten (10) annual installments, and that said report is hereby made a part of this ~Resolution. SECTION 2: That a rate of interest of zero per cent per annum on the unpaid balance is hereby fixed as the rate of interest which said assessment payment shall bear beginning on the thirty- first day .after confirmation of said assessments by the City Council SECTION 3: That following recordation of "Notice of Lien" in accordance with Section 5890, 5891, and 5892 of said Code the Superintendent of Streets shall deliver to the City Treasurer · a "Notice of Lien" for those properties specified herein where full cash payment has not been received, substantially in the form as specified in Section 5891 of said Code, and the City Treasurer shall thereafter bill and collect said annual assessment payments until such assessment is paid in full and is di.scharged Of record. SECTION 4: Annual payments of assessments shall become due on the 16th day of December in each year. The first payment becoming due on the 16th day .of December, 1972. Pursuant to Sectio~ 5892 of said Code, the City. may file and maintain an action to foreclose on such lien, 4 PASSED AND ADOPTED° at a regular meeting of the city.~..~....
