HomeMy WebLinkAboutCC RES 01-105 RESOLUTION NO. 01-105 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN APPROVING FINAL TRACT MAP 15993 TO SUBDIVIDE AN 18.95 ACRE SITE INTO TWENTY-TWO (22) NUMBERED LOTS AND FOURTEEN (14) LETTERED LOTS FOR DEVELOPMENT OF TWENTY-TWO (22) RESIDENTIAL UNITS The City Council of the City of Tustin does hereby resolve as follows: The City Council finds and determines as follows: A That Final Tract Map 15993 to subdivide an 18.95 acre into twenty-two (22) numbered lots and fourteen (14) lettered lots for the purpose of developing twenty,two (22) estate density residential units was submitted by Adams Streeter on behalf of Standard Pacific Homes for consideration; B That the City Council approved Tentative Tract Map 15993 on May 21, 2001; C That, as conditioned, the proposed subdivision is in conformance with the Tustin General Plan, Tustin Zoning Code, State Subdivision Map Act and the City's Subdivision Code. In addition, the project has been reviewed for consistency with the Air Quality Sub-Element of the City of Tustin General Plan and has been determined to be consistent or has been conditioned to be consistent with the Air Quality Sub-Element; D Pursuant to Section 15268(b) (Ministerial Projects) of the California Environmental Quality Act (CEQA), the Final Map is considered Statutorily Exempt from the requirements of CEQA; E, That the site is physically suitable for the type of development proposed; F That the site is physically suitable for the proposed density of development; G That the design of the proposed improvements is not likely to cause substantial environmental damage or substantially injure fish or wildlife in their habitat; H That the type of improvements proposed will not conflict with easements acquired by the public, for access through or use of the property within the project site; That the types of improvements proposed are not likely to cause serious public health problems; City Council Resolution No. 01-105 November 5, 2001 Page 2 J That on November 5, 2001, the City Council adopted Resolution No. 01- 104 for acceptance of a perpetual easement and right of way for street and highway purposes granted from the County of Orange to provide access from Peters Canyon Road into the tract; and, K That Condition 6.1 (F) of Resolution No. 01-53 and Condition 3.3 of Resolution No. 3787 are no longer needed due to the newly adopted City Council policy, which allows residential communities in East Tustin to maintain locked pedestrian gates. I. The City Council hereby approves Final Tract Map 15993 to subdivide an 18.95 acre site into twenty-two (22) numbered parcels and fourteen (14)lettered lots for the purpose of developing twenty-two (22) estate density residential units, subject to completion of Condition Nos. 1.3 and 2.1 of Resolution No. 01-53 to the satisfaction of the Community Development Department, Public Works Department and the City Attorney prior to recordation.
