RESOLUTION NO. 71-64
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, FINDING THAT CERTAIN AMEND-
MENTS TO. THE 1970 UNIFORM MECHANICAL CODE ARE
NECESSARY BECAUSE OF LOCAL CONDITIONS. '
'WHEREAS certain findings are required by Section 17958.7
of the Health and Safety code of the State of California as a
requisite for amending certain codes and,
WHEREAS the State Housing. Code, the Uniform Building
COde and the Uniform Mechanical Code formerly contained a
provision for the venting of.kitchens and it was found to be of
great benefit to home. buyers and renters, and
WHEREAS this provision was deleted by the International
Conference of Building Officials from the 1967 Uniform Mechanical
Code for the stated reason that it Was not desirable in some
geographic areas with severe weather problems, which conditions
do not.occur in Southern Californfa, and "

WHEREAS a vent to outside air'is considered to be a
necessity for the removal of Odors, grease and combustion
by-products, and
WHEREAS the homel buyer and renter in the City of Tustin
has become accustomed to expect' the inclusion of this vent as a
necessity and convenience and would consider the deletion thereof
a disservice,
NOW, THEREFORE be it resolved that the City Council of the
City of Tustin finds and determines that the following amendment,
contained in Ordinance No.517, is necessary because of local condi-
tions:

(C) KITCHEN VENTILATION"
"There shall be installed in the wall or ceiling,
approximately over the cooking facilities, a ventilating opening
with a minimum area of eight inches by six inches (8" x 6"),
connected by an incombustible ventilating duct free to the out-
side of the building. The ventilating duct for each kitchen
shall have a minimum cross-sectional area of twenty-eight square
inches (28 sq. in.).' An approvod forced-draft system of venti-
lation may be substituted for ~he natural draft ventilating
system."
PASSED AND ADOPTED at a regular meeting of the City
Council held on the 18th day of October., 1971.
