WHEREAS, the City Engineer has p~esented plans and. specifi cations for the construction of said work at these locations, · NOW THEREFORE, be it resolved that the plans and specifications presented by the City Engineer be and are hereby approved as the plans and specifications for the widening of Main Street from 250' w/o Preble Drive to Centennial Way. BE IT FURTHER RESOLVED that the City Clerk is hereby authorized · and directed to advertise as required by law for the .receipt of sealed bids or proposals, for the doing .of the work specified in the aforesaid plans and specifi'¢ations, which said advertisement shall 'be substantially in the following words..and figures, to wit.- "NOTICE TO CONTRACTORS" SEALED PROPOSALS Will be received at the office of the City Clerk, Tustin City Hall, 140 West Second Street, Tustin, California, until 11 o'clock A;'M. on the 3.0.th_day of A.ugust , 1971, at which time they will' be publicly opened and read, f0'r performing work as follows: ' In the City of Tustin and in unincorporated County territory on Main Street from 250' w/o Preble Drive to Centennial Way. Cash b. Cashier's check made payable to the City of T~stin c. Certified check made payable to the City of Tustin d. Bidder's bond executed by an accredited surety insurer, made payable 'to the City of Tustin · The security shall be in an amount equal to at least ten percent (10%) of the amount of the bid. A bid shall not be con- sidered unless one of the forms of bidder's security is enclosed therewith. , . A Surety Bond for payment of labor and materials ~ill be required in.th'e amount of fifty percent (50%) of the estimated total contract price and a Faithful Performance Bond in the amount of one hundred percent (100%) of the estimated total contract price. City of Tustin reserves the right to reject any or all bids, and/or waive any informality on a bid. No bidder may withdraw his bid for a period° of thirty (30) days after the date set for the openin.g thereof. , 'Bid Alternate "A" and Bid Alternate "B" are considered equal and the contract will be awarded on the basis of whichever is the lowest total bid for the project. P~ovisions of the State Contract Act are not applicable, .and prospective bidders will not be required to be prequalified. All work to be done under the direct supervision of the City Engineer, City of Tustin. Ail work to be paid for at the unit prices bid from appropriate monies. Said .City of Tustin, pursuant to the Labor Code of the State , of California, has ascertained and determined that the general prevailing rate of hourly and per diem wages in the locality in which the said work herein described is to be performed, for each craft or type of workmah or mechanic needed to execute the contract and also the general prevailing rate for legal holidays and over- time work for each craft or type of workman or mechanic, to be as A-3 indicated in Resolution 70-42 as previously published in a news- paper of general circulation,, and on file in the office of the · Employer payments' other than those, itemized therein, as defined in Section 1773.1 of the Labor Code, are to be paid in accordance with the terms of the collective bargaining agreement appli'cable to the type or classification of the workmen or mechanics employed on the project.
