HomeMy WebLinkAboutCC RES 71-28 RESOLUTION NO. 71-28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, FINDING AND DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE, AND ORDERING, THE ACQUISITION BY CONDEMNATION OF CERTAIN PROPERTY FOR PUBLIC PURPOSES. The City Council of the City of Tustin hereby resolves as follows.- 1. The City Council finds and determines that public interest and necessity require the acquisition by the City of Tustin of that certain property located in the City of Tustin, County of Orange, State of' California, more particularly described Exhibit "A" attached hereto and incorporated herein by this ference as though.set forth herein in full, for a public purpose, namely, for community park and recreation facilities, and for such~ other public uses as may be authorized by law. 2. The City Council finds and determines that the said property 'is necessary for such public use. 3. The City Council finds and determines that such proposed public improvement and use will be located in a manner which is most compatible with the greatest public good and the least private injury. ,. 4. The City Council hereby authorizes and directs the City Attorney, James G. Rourke, to institute eminent domain proceedings in the Superior Court of the State of California for the County of Orange for the purpose of acquiring a fee title and all right, title and interest in and to said property for such public use. : PASSED AND ADOPTED at a regular meeting of the City Council, held on the 21st day of June, 1971.
