A RESOLUTON OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING PLANS AND
SPECIFICATIONS FOR THE CONSTRUCTION OF STREET
IMPROVEMENTS: PROJECT I - RED HILL AVENUE;
PROJECT II - CENTENNIAL WAY; PROJECT III -
PROSPECT AVENUE, AND AUTHORIZING AND DIRECTING
THE CITY CLERK TO ADVERTISE FOR BIDS.
WII}.EREAS, it is the int'ention of the City Council of the
City of Tustin, California, to construct street improvements
on Red Ifil].' Avenue between Bryan and First Street, on .'Centennial
,
Way from Main Street to 675'. ~north, and on Prospect Avenue from
165" south of Lockwood to 142' north of Orangewood, and
W}{EREAS, the City .Engineer has presented plans and speci-
fications for the construction of said work at these locations,
NOW, THEREFORE, be it resolved that the plans and speci-
fication presented by ,the City Engj. neer be and are hereby
approved as the plans and ...specifications for the construction
of street improvements on Red }{ill Avenue between Bryan and First
Street, on Centennial Way from Main Street to 675' north, and on
Prospect Av. enue .from 165' south of Lockwood to 14'2' north of
Orangewood.
BE IT FURTI.IER RESOLVED that the City Clerk is hereby authorized
and directed to advertise as'.reqdired by law for the receipt of
sealed bids or proposals for the doing of the work specified in
the aforesaid plans and specifications which said advertisement
shall be substantially in the following words and figures, to-wit-
"NOTICE.. TO CONTRACTORS"
SEALED PROPOSALS will. be received at the .office of the City
Clerk, Tustin City Hall,· 140'West Second Street, Tustin, California,
until 11 o'clock A.M. on t·he Seventeenth day of· May
1971, at which time they.will be publicly opened and read, for
performing work as follows-

Bids are required for the entire work described herein for

Plans, specification, and proposal forms to be used for bidding
on ti]is project can on].y be' obtained at the Tustin City Hall,
Tustin, California.
In conformance.with Section 37931 of the Government Code, all
bids shall be presontod under seal'ed cover on the proposal form
provided and accompanied by one of the following forms of bidder's
security.
·
a. Cash
b. Cashier's ch~ck made payable to the City of Tustin
c. Certified check made payable to the City of Tustin
d. Bidder's bond executed by an accredited surety
insurer, made payable to the City of Tustin
The security shall be in an amount equal'to at 'least ten
percent (10%) of the 'amount of the bid. A. bid shall not be con-
sidered unless one of the forms of bidder's security is enclosed
therewi'th. '
A Surety'Boned for payment of labor and materials will be
reqUired in the amount of fifty percent (50%) of the estimated
total contract price and a Faithful Performance Bond in the amount
of one hundred percent (100·%) of the estimated total contract price.

City of Tustin reserves the right to reject any or all bids,
and/or waive any informality on a bid. No bidder may withdraw his
bid for a period of thirty (30) days after the date set for the
opening thereof.
Bid alternate "A" and bid alternate "B" are considered equal
and the contract will.be awarded' on the basis of whichever is the
lowest total bid for the three projects. The overall contract has
been divided into three Projects for accounting purposes only.
Provisions of the State Contract Act are not applicable, and
prospective bidders will not be required to be prequalified.
Ail work to be done under the direct supervision of the City
Engineer, City of Tustin.

All work to be paid for at the unit prices bid from appropriate
monies.
Said City of Tustin, pursuant to the Labor Code of the State I
of California, has ascertained and determined t. hat the general
prevailing rate of hourly and per diem wages in the locality in which
the said work' herein doscribed is to be performed, for each craft
or type of work,nan or mect~anic needed to execute the contract
and also the goneral prevailing rate for logal holidays and over-
time work fqr ~.ch craft or type of workman or mechanic, to be as

Employer payments other than those itemized therein, as
defi~ed in ~e
.-, orion 1773.]. of the Labor Code, are to be paid in
accordance with the terms of the collective bargaining agreement
applicable to the type or classification of the workmen or
mechanics employed on the project.

Copies of all collective bargaining agreements relating to ~ ~
the work' as set forth in the aforementioned Labor Code are on ~:
file and' available for inspection in the office of the Department
of Industrial Relations, Division of Labor Statistics and Research.

BE IT AL~O ~RESOLVED that the City Council of the City of
Tustin ha~; ascertained and does hereby determine that' the general
prevailing rate of wages and employer p'ayments in the locality of
the City of Tustin, California, for each craft or type of workman
needed to execute the work herein above specified is as set forth
in Resolution 70-42. ·
