A RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN
INITIATED BY THE CITY COUNCIL OF THE CITY OF TUSTIN
TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY
DESCRIBED HEREIN, AND DESIGNATED AS "SEVENTEENTH
STREET - PROSPECT AVENUE ANNEXATON NO. 61" TO THE
CITY OF TUSTIN, AND GIVING NOTICE OF THE PROPOSED
ANNEXATION.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TUSTIN:
6 1. That, pursuant to the provisions of the Annexation of Uninhabited
Territory Act of 1939, proceedings have been initiated by the Council of the
~ City of Tustin, on its own motion, to annex to the City of Tustin all that
uninhabited territory situate in the County of Orange, State of California,
8 hereby designated as SEVENTEENTI{ STREET - PROSPECT AVENUE ANNEXATION NO. 61
described, in Exhibit A, attached hereto and incorporated herein by this
9 reference as though.set forth hereat in full.

~0 2. That the City Council hereby finds and determines that all
of said territory is uninhabited within the meaning of Government Code Section
~1 35303, on the date of the adoption of this Resolution, that said territory is
contiguous to the CitY of Tustin.

3. That the City Council of the City of Tustin desires to annex said
~ uninhabited territory to the City of Tustin for the following reasons: That
the territory is contiguous to the City of Tustin, and its proposed annexation
~ will contribute to and facilitate the orderly growth and development of both
the City and the territory proposed to be annexed; will facilitate and contribut(
15 to the proper and orderly layout, design and construction of streets, gutter, s_~.
sidewalks, sanitary and storm water sewers and drainage facilities, both '
~6 within the City and within the territory proposed to be annexed; and will p~
vide and facilitate proper over-all planning and zoning of lands, and sub-
~7 division df lands in said City and said uninhabited territory., in a manner
most conducive to the welfare of said City and said uninhabited territory.

4. That the Local Agency Formation Commission did, in session duly
~9 assembled, on October 14, 1970, approve said proposed annexation.
~0 5. That December 7, 1970, at the hour of 7:30 P.M. in the Council
Chambers, 275 South "C" Street (corner of Third Street), City of Tustin, County
21 of Orange, State of California, is hereby fixed as the time and place when
and where any person owning real property within the uninhabited territory
22 above described and proposed to be annexed to the City of Tustin, and having
any objections to the proposed annexation, may appear before the Council of
2~ the City of Tustin, and show cause why such uninhabited territory should not
be so annexed to said City of Tustin; such protests must be in writing, and
24 may be filed at any time prior to the final adjournment of the hearigg on
protests, and shall state the name or names of the owners of the property
~5 affected, and the street address or 'other description of the property sufficient
to identify it on the last equalized assessment roll.

6. That the City Clerk of the City of Tustin is hereby authorized and
2'~ directed to cause a copy of this Resolution to be published at least twice,
nd; oftener than once a week, in the Tustin News, a newspaper of general cir{
28 lation published in said City of Tustin, the City to which it is proposed t¢
annex the aforesaid territory, and also in the Santa Ana Register, a newspap~:~
29 of general circulation published outside the City of Tustin, but in the Count~,
of Orange, California, the County in which is located the territory proposed to
~0 be annexed to the City of Tustin.
7. The City Clerk is further authorized and directed to cause written
notice of such proposed annexation to be mailed to each person to whom land
within tt~e%te.~-.itory proposed to be annexed is assessed in the last equalized

County assessment roll available on the date the above said proceedings were
initiated, at the addresses shown on said assessment roll or knoWn to the
Clerk, and to any person wl~o has. filed his name and address and the designation
of the lands in which, he has an interest, either legal or equitable with the
Clerk.

8. In the event:: any land within tl~o territory proposed to be annexed
is owned By the County, the City Clerk is directed to cause a written notice of
such proposed' annexation to be'mailed to the Board of Supervisors of the Counl:y.
9. In the event there is, upon the land proposed to be annexed, a
structural improvement, owned, being..acquired, or leased by a County fire
protection district, the said Clerk is directed to cause a written notice of
such propos:ed annexation to be mailed to the governing Ix>dy of 'such district.
. 10. The City Clerk is directed to cause written notice to be given
to such other persons as may be legally entitled thereto, in the manner required
by law.

Tustin held on the 19th day of October, 1970

SEVENTEENTH STREET-PROSPECT AVENUE ANNEXATION NO. 61
TO THE CITY OF TUSTIN, CALIFORNIA
Beginning at the northwesterly corner of Tract No. 3798 as per
map recorded in Book 142, Pages 20 through 22 inclusive of Miscellaneous
Maps, Records of Orange County, California, said point of beginning also
lying on the easterly boundary of the Vicente Yorba Tract as per map
recorded in Book 2, Page 14 of Miscellaneous Maps, Records of said
Orange County and the existing most easterly boundary line of the City
of Tustin, California, as established by the Yorba Street Annexation,
per Ordinance No. 135, passed and adopted May 9, 1960, said point of
beginning being distant S. Oo10'28" E., 278.76 feet from the north-
easterly angle point in said existing most easterly boundary of the
City of Tustin;
Thence, leaving said City boundary and said easterly boundary of
the Vicente Yorba Tract, N. 88°52'50" E., along the northerly boundary
of said Tract No. 3798, a distance of 622.75 feet, to an angle point
in said northerly boundary, said angle point also lying on the
westerly boundary of Tract No. 2564 as per map recorded in Book 74,
Pages 23 and 24 of Miscellaneous Maps, Records of said Orange County
Thence, leaving said northerly boundary of Tract No. 3798,
N. 0°14'10" W., along the westerly boundary of said Tract No. 2564,
a distance of 462.87 feet, to the northwesterly corner of said Tract
No. 2564;
Thence, N. 88°52'50" E., along the northerly boundary of said
Tract No. 2564, a distance of 594.00 feet, to the northeasterly corner
of said Tract No. 2564, said northeasterly corner also being a point
lying on the centerline of Prospect Avenue and on the easterly boundary
of the Teodocio Yorba allotment;
Thence, N. 0°14'10" W., along the centerline of Prospect Avenue,
and along the easterly boundary of the Teodocio Yorba allotment, a
distance of 556.38 feet, to the intersection with the centerline of
Seventeenth Street, said point of intersection also being the north-
easterly corner of the Teodocio Yorba allotment;
Thence, S. 88°52'50" W., along the centerline of Seventeenth
Street and along the northerly boundary of the Teodocio Yorba allotment,
a distance of 1215.65 feet, to the northwesterly corner of the
Teodocio Yorba allotment, said northwesterly corner also being an
angle point in the centerline of Seventeenth Street;
Thence, S. 89°31'42" W., along the centerline of Seventeenth
Street, a distance of 180.82 feet, to the intersection with the
centerline of Yorba Street, said point of intersection also being the
southeasterly corner of Lot 14, Block B, of the A. B. Chapman Tract,
as per map recorded in Book 102, Page 15 of Miscellaneous Maps, Records
of said Orange County;
Thence, N. 0°05'27" E., along the centerline of Yorba Street and
along the easterly line of said Lot 14, a distance of 40.01 feet,
to the intersection of a line 40.00 feet northerly of, as measured at
right angles from, and parallel to, that portion of the centerline of
Seventeenth Street located westerly of the centerline of Yorba Street;
Thence, leaving the centerline of Yorba Street and said easterly
line of Lot 14, N. 88°39'33" W., along last mentioned parallel line,
a distance of 20.00 feet, to an angle point in the existing boundary
of the City of Tustin, California, as established by the Yorba Street
Annexation No. 2, per Ordinance No. 139, passed and adopted September
6, 1960;

along said City boundary, a distance of 436.04 feet, to an angle
point in said City boundary, said angle point being a point on the
boundary of the Yorba Street Annexation to the City of Tustin,
California, per Ordinance No. 135, passed and adopted May 9, 1960;
Thence, S. 0°05'27" W., along said City boundary as established
by last mentioned annexation, a distance of 85.00 feet, to an angle
point in said City boundary;
Thence, continuing along said City boundary, S. 88°39'33" E.,
a distance of 72.75 feet, to an angle point in said City boundary,
said angle point also lying on the westerly line of Lot 2 of the
Vicente Yorba Tract, as per map recorded in Book 2, Page 14 of
Miscellaneous Maps, Records of said Orange County;
Thence, continuing along said City boundary, S. 0°10'40" E.,
