A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING PLANS AND
SPECIFICATIONS FOR THE CONSTRUCTION OF STREET
IMPROVEMENTS ON LAGUNA RD., NEWPORT AVE. AND
BROWNING AVE., AND AUTHORIZING AND DIRECTING
THE CITY CLERK TO ADVERTISE FOR BIDS.
WHEREAS, it is the intention of the City Council of the
City of Tustin, California, to construct street improvelnents
on Laguna Road between Newport Avenue and E1 Camino I~eal, on
Newport Avenue between Laguna Road 'and Bonita St. a~d on
Browning Avenue between Nisson Road and Yolanda, and.
WHEREAS, the City Engineer has presented plans and speci-
fications for the construction of said work at these locations,

NOW THEREFORE, be it resolved that the plans and speci- '
fication presented by the City Engineer be and are hereby
approved as the plans and specifications for the construction ..
of street improvements on Laguna Road between Newport Avenue
and E1 Camino Real, on Newport Avenue between Laguna Road and
Boniha St. and on Browning Avenue between Nisson Road and

' BE IT FURTHER RESOLVED that the Cit~ .C. lerk .is hereby
authorized and directed to' advertise as required by law for the
receipt of se'aled bids. or proposals for the doing o'f the work
specified in the aforesaid plans and specifications which said
advertisement shall be substantially in. the following words and
figures, to-wit: .

SEALED PROPOSALS will be received at the' office of the

Plans, specification, and proposal forms to be used for
bidding on this project, can. only be obtained at the Tustin City
Hall, Tustin, California. '

In ¢o'nformance with Section 37931 of the Government Code,
all bids shall be presented under Sealed cover on the proposal
form provided 'and accompanied by one of. the following forms of
bidder's security:
·
a. Cash
b. Cashier's check made payable to the City of Tustin
c. Certified check made payable to the City of Tustin
d. Bidder's .bond executed by an accredited, surety
insurer, made payable to the City of Tustin
The security shall be in an amount equal to at least ten
percent (10%) of the amount of the bid. A bid shall not be con-
sidered unless one of .the forms of bidder's security is enclosed
the rewi th. ,

A Surety Bond for payment of labor and materials will be
required in the amount of fifty percent (50%) of the estimated
total contract price and a Faithful Per'formance Bond in the amount
of one hundred percent (100%) of the estimated total contract price.
City of Tustin reserves the right to reject any or all bids,
and/or waive any informality on a bid. No bidder may withdraw his
bid for a period of thirty (30) days after the date set fSr the .......
opening thereof.
Provisions of the State Contract Act are' not applicable, and,
prospective bidders will not be required to be prequalified.
Ail work to be done under the 'direct supervision of the City
Engineer, City of Tustin. --

Ail work to be paid for at the unit prices bid' from appropriate
monies.

Said City of Tustin, pursuant to the Labor Code of the State
of California, has ascertained and determined that the general
prevailing rate of hourly and per diem wages in the locality' in
which the said work herein described is to be performed, for each
craft or type. of workman or mechanic needed to execute the contract
and also the general prevailing ra.te for legal holid.ays a'nd over-
time work for each craft or type of workman or mechanic, to be as

Embloyer payments other than those itemized th~:rein, as

Copies of all collecti've bargaining agreements' relating to
the work as S'et forth in the' aforementioned Labor Ce.de are on
file and available for inspection in the office Of the' Department
of Industrial Relations, Division of Labor Statistics and Research.
