HomeMy WebLinkAboutCC RES 70-17RESOLUTION NO. 70-17 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, ANNEXING TO THE CITY OF TUSTIN CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN, AND DESIGNATED "BROWNING AVENUE - NISSON ROAD ANNEXATION NO. 60. The City Council of the City of Tustin, California, does hereby resolve as follows: 1) Pursuant to the provisions of the Government Code of the State of California, application was made to the Local Agency Formation Commission to annex to the City of Tustin all that un- inhabited territory situated in the County of Orange, State of California, hereby designated as "Browning Avenue - Nisson Road Annexation No. 60", and described in Exhibit "A" attached hereto and incorporated herein by this reference as though set forth herein in full. 2) The Local Agency Formation Commission, in session duly assembled, on April 8, 1970, did approve said proposed annexation, and authorized the City Council to annex said territory without notice, hearing or election. 3) The City Council finds and determines that all of said territory is uninhabited, within the meaning of the govern- ment Code, on the date of adoption of this Resolution, and that said territory is contiguous to the City of Tustin. 4) All of the owners of land within the territory proposed to be annexed have given their written consent to the annexation of said territory to the City of Tustin. 5) The City Council desires to annex said uninhabited territory to the City of Tustin for the following reasons: The territory is contiguous to the City of Tustin and its proposed annexation will contribute to and facilitate the orderly growth and development of both the City and the territory proposed to be annexed, will facilitate and contribute to the proper and orderly layout, design and construction of streets, gutters, sidewalks, and sanitary and storm-water sewers and drainage facilities, both in the City and in the territory proposed to be annexed, and will provide and facilitate proper over-all planning and zoning of lands in said City and in said uninhabited territory, in a manner most conducive to the welfare of the City and said uninhabited territory) 6) The City Council of the City of Tustin does hereby I approve the annexation of the territory hereinabove described to th1 City of Tustin, and does hereby further resolve that the said territory be and it is hereby annexed to the City of Tustin, effec-I tive upon the date of the filing of the certified copy of this Resolution with the Secretary of State of the State of California. 7) The City Clerk of the City of Tustir_ is hereby directed without delay to transmit to the Secretary of State of thee. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin, California, ~1~~ the 20th day of April, 1969. ~~ ' ~ _ i ATTEST : ~`" ~- ~/ =G~- y~ CI CLERK _ LEGAL DESCRIPTION FOR T1iE BROWNING ;NUE - NISSON ROAD ANNEXAT~'``~N NO. 60 TO 't' E CITY OF TUSTIN , CALIFO to Being that portion of Lot 36, Block 11, as shown on a map of Irvine's Subdivision, recorded in Book 1, Page 88 of Miscellaneous Maps, Official Records of Orange County, California, described as follows: Beginning at the intersection of the centerline of Browning Avenue with the southeasterly prolongation of the northeasterly boundary of Tract No. 5997, as shown on a map thereof recorded in Book 226, Pages 40 and 41 of Miscellaneous Maps, Official Records of said Orange County, said point of beginning also lying on the southeasterly line of Lot 36, Block 11, of said Irvine's Subdivision and lying on the existing boundary of the City of Tustin, California, as established by the Browning Avenue - Walnut Avenue Annexation, Ordinance No. 404, passed and adopted June 17, 1968; Thence, N. 400-21'-29" E. along said centerline of Browning Avenue and along said southeasterly line of Lot 36, Block 11 and along said City boundary, a distance of 597.15 feet to an angle point in said City boundary, said angle point being S.400-21'-29" W. a distance of 63.02 feet from the most easterly corner of said Lot 36, Block 11, Irvine's Subdivision; Thence, leaving said City boundary and continuing N. 40°-21'-29" E. along said southeasterly line of Lot 36, Block 11, a distance of 17.02 feet to a point which is S. 40°-21'-29" W. a distance of 46.00 feet from the most easterly corner of said Lot 36, Block 11, Irvine's Subdivision; Thence, N. 490-41'-37" W. a distance of 330.24 feet; Thence, S. 400-21'-22" W. a distance of 50.00 feet to the most northerly corner of that parcel of land described in a deed from Leo Baudino and Barbara Baudino et al to Michael M. Lloyd and Archie A. Lloyd, recorded in Book 7992, Page 34, in Official Records of Orange County, California; Thence, continuing S. 400-21'-22" W. along the northwesterly boundary of the parcel described in said deed, a distance of 280.00 feet to the most westerly corner of the parcel described in said deed, said most westerly corner also being the most northerly corner of that parcel of land described in a deed from First Assembly of God of Tustin, California to Southern California District Council Assembly of God, Inc., recorded in Book 8738, Page 655, in Official Records of Orange County, California; Thence, continuing S. 400-21'-22" W. along the northwesterly boundary of the parcel described in said deed recorded in Book 8738, Page 655, a distance of 284.11 feet to the most westerly corner of the parcel described in said deed recorded in Book 8738, page 655, said most westerly corner also being the most northerly corner of said Tract No. 5997; Thence, S. 490-40'-58" E.along the southwesterly boundary of the parcel described in said deed recorded in Book 8738, Page 655 and along the northeasterly boundary of said Tract No. 5997, a distance of 297.22 feet to the most easterly corner of said Tract No. 5997; Thence, continuing S. 490-40'-58" E. along the southwesterly boundary of the parcel described in said deed recorded in Book 8738, Page 655, a distance of 3.00 feet to the most southerly corner of said parcel; Thence., continuing S. 490-40'-58" E. along the southeasterly prolongation of the southwesterly boundary of the parcel described in said deed recorded in Book 8738, Page 655, and along the southeasterly prolongation of the northeasterly boundary of said Tract No. 5997, a distance of 30.00 feet to the point of beginning. ~~ STATE OF CALIFORNIA) COUNTY OF ORANGE ) SS CITY OF TUSTIN ) RUTH C.
