HUSTON, CITY MANAGER OFFICE OF THE CITY CLERK SUBJECT: CONFLICT OF INTEREST- DESIGNATED POSITIONS '~' SUMMARY: Designated Positions in the City's Conflict of Interest Code require updating each year prior to the annual filing of Statements of Economic Interests by City employees and officials. RECOMMENDATION: Adopt Resolution No. 01-115 modifying the Appendix (Designated Positions) contained in the City's Conflict of Interest Code to add the positions of Assistant Director of Public Works, Water Treatment Supervisor, Maintenance Supervisor, Principal Civil Engineer, Senior Information Technology Specialist, Senior Management Analyst, Administrative Services Manager, Administrative/Support Services Manager, and Support Services Supervisor. FISCAL IMPACT: None BACKGROUND: The Appendix (Designated Positions) of the City's Conflict of Interest Code defines those officials and employees who are required to file Statements of Economic Interests (Form 700). Annually, the Designated Positions should be modified to reflect changes that have occurred in the City's Classification Plan or to reflect additions/deletions of positions as determined by the Gity Attorney. The City Attorney has recommended that Assistant Director of Public Works, Water Treatment Supervisor, Maintenance Supervisor, Principal Civil Engineer, Senior Information Technology Specialist, Senior Management Analyst, Administrative Services Manager, Administrative/Support Services Manager, and Support Services Supervisor file Statement of Economic Interests. With adoption of Resolution No. 01-115, the Designated Positions will be amended to add the positions of Assistant Director of Public Works, Water Treatment Supervisor, Maintenance Supervisor, Principal Civil Engineer, Senior Information Technology Specialist, Senior Designated Positions December 3,2001 Management Analyst, Administrative Services Manager, and Suppo~Services Supervisor. · Beverley White Chief Deputy City ~erk Attachment Manager, Ad m in ist rative/S uppo rt Services Cm:desgposm2001 RESOLUTION NO. 01-115 10 14 19 20 2.2 23 24 25 27 28 29 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, MODIFYING THE DESIGNATED POSITIONS CONTAINED IN THE CONFLICT OF INTEREST CODE OF THE CITY OF TUSTIN The City Council of the City of Tustin does hereby resolve: A, That the Appendix of the Conflict of Interest Code of the City of Tustin, approved by the City Council with the adoption of Resolution No. 00- 69, should be modified and updated to add the nine (9) positions of Assistant Director of Public Works, Water Treatment Supervisor, Maintenance Supervisor, Principal Civil Engineer, Senior Information Technology Specialist, Senior Management Analyst, Administrative Services Manager, Administrative/Support Services Manager, and Support Services Supervisor to the positions required to file a Statement of Economic Interests. B= That the revised Appendix, attached hereto, be approved and the Conflict of Interest Code be modified accordingly. C, That pursuant to Section 4 of the Conflict of Interest Code of the City of Tustin, the City Council, as the Code-reviewing body, hereby instructs all persons occupying a Designated Position to file with the City Clerk a Statement of Economic Interests as required' assuming position, annually, and leaving position. If the City Manager determines that a particular consultant must comply with the above disclosure requirements, the City Manager shall notify the consultant in writing. The written notification shall include a description of the consultant's duties and, based upon those duties, a statement of the extent of the disclosure requirements. The City Manager's notification is a public record and shall be retained for public inspection by the City Clerk in the same manner and location as this Conflict of Interest Code. DISCLOSURE CATEGORIES' The foregoing positions (Consultants excluded) will be assigned Disclosure Categories of I, II, and III. Category I' Investment and Real Property Disclosure. Category I1' Personal Income Disclosure. Category II1' Business Income, Commissions and Position Disclosure. * The City Council, City Manager, City Attorney, City Treasurer, and Planning Commissioners are roquirod to file Statement of Economic Interests Form 700 pursuant to Government Code Section 87200 and are, therofom, not in¢ludod as dosignated positions in this ^ppendix.
