ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO
FILE A NOTICE OF COMPLETION FOR ANNUAL SIDEWALK, CURB AND
GUTTER REPAIR PROJECT, FY 2000-2001 (PROJECT NO. 402-6235)
SUMMARY
Construction of the City's Annual Sidewalk, Curb and Gutter Repair Project, FY 2000-2001 for
correcting tripping hazards and installing curb access ramps and missing segments of sidewalk
has been completed to the satisfaction of the City Engineer, and is now ready for City Council
acceptance.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 01-88 accepting the construction of
the City's Annual Sidewalk, Curb and Gutter Repair Project, FY 2000-2001 (Project No. 402-6235)
and authorizing the recordation of the Notice of Completion, and direct the City Clerk to:

Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of
recordation of the Notice of Completion; and
2. Release the Faithful Performance Bond not sooner than one year after the date of
recordation of the Notice of Completion.
Assuming no claims or stop notices are filed, it is further recommended that 35 days after the date
of recordation of the Notice of Completion the City Council authorize payment of the final 10%
retention in the amount of $14,957.59 to CJ Construction, Inc. This amount together with previous
payments of $134,618.35 represents 100% of the final contract cost.
FISCAL IMPACT
The final cost of construction for this project was $149,575.94. Funding for this project was
provided through the FY 2000-2001 Public Works Department/Engineering Division Operating
Budget. This project is part of the City's on-going Maintenance of Effort requirements for
compliance with Measure "M".
DISCUSSION
This project consisted of the removal and replacement of concrete sidewalk, curb and gutter and
drive aprons to correct tripping hazards at various locations throughout the City. Areas where
roots from parkway trees repeatedly damaged and raised the adjacent sidewalks creating tripping
hazards have been addressed with the project. Thirteen parkway trees were removed and
replaced with trees that have a less invasive root system.

The project also addressed improvements throughout the City to comply with the Americans with
Disabilities Act requirements. These locations were requested by citizens or were identified by
staff to provide curb access ramps as well as completion of missing segments of sidewalk to
improve disabled/pedestrian access at various locations throughout the City.
Construction has been completed to the satisfaction of the City Engineer and the project is now
ready for City Council acceptance. This project was previously scheduled for City Council
acceptance at the completion of construction in August, 2001. However, the City received a "Stop
Notice" from the concrete provider for this project which delayed bringing this item fo~ard to the
City Council. The City has recently received the "Release of Stop Notice" from the claimant and
the project is now ready for City Council acceptance.

RESOLUTION NO. 01-88
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING THE WORKS oF IMPROVEMENT AND
AUTHORIZING RECORDATION OF A NOTICE OF COMPLETION FOR
THE ANNUAL SIDEWALK AND CURB AN.D GUTTER REPAIR
PROJECT, FY 2000-2001 (PROJECT NO. 402-6235)
WHEREAS, CJ Construction, Inc. having a contract with the City of
Tustin to construct the hereinafter described public works and improvements;
and
WHEREAS, the City Engineer has duly certified to the construction and
completion of said public works and improvements hereinafter mentioned in a
manner satisfactory to the City Council of the City of 'l-ustin; and
WHEREAS, the City Council finds that said contractor has completed
said public works and improvements hereinafter more particularly described
in accordance with the provisions .of the contract documents and the Notice of
Completion, and acceptance of said public works and improvements should
be filed and payment of the balance due said contract authorized in
accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Tustin that said public works and improvements are found to be complete,
and the same is hereby accepted. Said public works and improvements are
more particularly described as follows:
ANNUAL SIDEWALK AND CURB AND GUTTER REPAIR PROJECT,
FY 2000-2001 (PROJECT NO. 402-6235)
BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin
is hereby authorized to execute and file a Notice of Completion for the
acceptance of said public works and improvements described herein as
required by law.
· PASSED AND .ADOPTED at a regular meeting of the City Council of the
City of Tustin held on the 3rd day of December 2001. .
