HomeMy WebLinkAboutCC RES 1001~0 ~? ~8 ~0 RESOLUTION NO. 1001 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, ANNEXING TO THE CITY OF TUSTIN CERTAIN UNINHABITED TERRITORY HEREIN, AND DESIGNATED "FOURTH STREET AND NEWPORT FREEWAY ANNEXATION" · The City Council of the City of Tustin, California, does hereby resolve as follows- . 1) Pursuant to the provisions of the Government Code of the State of California, application was made to the Local Agency Formation · Commission .to annex to the City of Tustin all that uninhabited territory situated' in the County of Orange, State of California, hereby designated as '~ourth Street and Ne .wport Freeway Annexation,'" and described in . · Exhibit "A" attached hereto and incorporated, herein by this reference as though set forth herein in full.' The Local Agency Formation Commission, in session duly assembled, on May 28, 1969, did approve said proposed annexation,, and authorized the City Council to annex said territory without notice, hearing ~r 'election. 3) The City Council finds and determines 'that all of said territory is uninhabited, within the meaning of the Government Code, on .... thei..date_.of ..... adoption, of. this. Resolution,--aDd. that--.said.~territory .is contiguous · to the City of Tustin. 4) Ail of the owners of land within the territory proposed to be annexed have given their written consent to the annexation of sai~ · territory t'o.the City of Tustin. The City Council desires to annex said uminhabited territory to the City of Tustin.for the following reasons- The territory is con- tiguous to the City of Tustin and its proposed annexation will contribute. o. to and facilitate the orderly growth and development of both the City and · the territory proposed to be annexed, will facilitate and contribute to · the proper and orderly layout, design and construction of streets, gutters, , sidewalks, and sanitar,/.and storm-water sewers and drainage facilities, both in the City and in the territory proposed to be anmexcd, and will provide and facilitate'proper over-all planning and zoning of l~nds in said I City and in s~ld .uninhabited territory, in a manner most conducive to the welfare of the City and said uninhabited territory. 6) The' City Council of the City of Tustin does heCeby approve · the annexation of the territory herein described to the City of Tustin, and does hereby further resolve that the said terr~itory be and it is hereby 0' annexed to the City of Tustin, effective upon the date of the filing of a certified copy of this Resolution with the Secretary of State of the Stat'e .12 18 '2? ~8 of California. ~9 ~0 7)' ..The City Clerk of the City of Tustin is hereby directed without delay to transmit to the Secretary of State. of the State California a certified copy of this Resolution. .....
