BEREFT, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE THE NOTICE OF COMPLETION FOR THE ANNUAL MAJOR PAVEMENT MAINTENANCE PROJECT, FY 2007-2008 (CIP NO. 7001) AND THE ANNUAL SIDEWALK REPAIR PROJECT, FY 2007-2008 (PROJECT NO. 402-6235) SUMMARY Construction of the Annual Major Pavement Maintenance Project, FY 2007-2008 (CIP No. 7001) and the Annual Sidewalk Repair Project, FY 2007-2008 (Project No. 402-6235) have been completed to the satisfaction of the City Engineer and are now ready for City Council acceptance. RECOMMENDATION It is recommended that the City Council: 1. Adopt Resolution No. 08-67 accepting the Annual Major Pavement Maintenance Project, FY 2007-2008 (CIP No. 7001), and the Annual Sidewalk Repair Project, FY 2007-2008 (Project No. 402-6235); and 2. Authorize the City Engineer to execute and file the Notice of Completion with the County Recorder's Office. FISCAL IMPACT The final construction cost for the Annual Major Pavement Maintenance Project (CIP No. 7001) is $1,212,199.64. The project was funded by the City's Capital Improvement Program (CIP) Budget. A portion of the work on Irvine Boulevard was performed within County of Orange jurisdiction which totaled approximately $94,073, for which the City will be reimbursed under a previously executed Cooperative Agreement. The final construction cost for the Annual Sidewalk Repair Project (Project No. 402-6235) is $144,841.02, which was funded by the Engineering Division's Annual Sidewalk Repair Budget. Acceptance of Public Improvements and Authorization to File the Notice of Completion for the Annual Major Pavement Maintenance Project, FY 2007-2008 (CIP No. 7001) and the Annual Sidewalk Repair Project, FY 2007-2008 (Project No. 402-6235) October 21, 2008 Page 2 Project construction, along with design and construction management, has increased the City's infrastructure assets by approximately $1,557,035. Any increased infrastructure valuation amount will be added to the City's infrastructure inventory after final project accounting by the Finance Department as required by Statement 34 of the Governmental Accounting Standards Board (GASB 34). Draft final cost information is currently shown on the attached GASB 34 Infrastructure Inventory Valuation Forms. DISCUSSION The Annual Major Pavement Maintenance Project, FY 2007-2008 (CIP No. 7001), and the Annual Sidewalk Repair Project, FY 2007-2008 (Project No. 402-6235) were completed on September 19, 2008. All of the work for these projects has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance. Tim D. Kasdan Engineering Services Manager Attachments: Resolution No. 08-67 Location Exhibit GASB 34 Infrastructure Inventory Valuation Form S:\City Council Items\2008 Council Items\NOC Annual Pvmt Maint Sidewalk Repair 07-08 & Reso 08-67.docx RESOLUTION NO. 08-67 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR THE ANNUAL MAJOR PAVEMENT MAINTENANCE PROJECT, FY 2007-2008 (CI P NO. 7001) AND THE ANNUAL SIDEWALK REPAIR PROJECT, FY 2007-2008 (PROJECT NO. 402- 6235) WHEREAS, Calmex Engineering, Inc., having a contract with the City of Tustin to construct the hereinafter described public works and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvement hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public works and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public works and improvement is found to be complete, and the same is hereby accepted. Said public works and improvement is more particularly described as follows: Annual Major Pavement Maintenance Project, FY 2007-2008 (CIP No. 7001) and Annual Sidewalk Repair Project, FY 2007-2008 (Project No. 402-6235) BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvement described herein as required by law. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on the 21St day of October 2008.
