RESOLUTION NO. 972
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, AMENDING RESOLUTION
NO. 968 RELATIVE TO COUNCIL POLICY NO. 20-4.
The City· Council of the City of Tustin, California,
does hereby ·resolve as follows-

to Council Policy No. 20-4 as follows:

That Council-POlicy No. 20-4, as amended, relative
to Special Leaves of Absence and Holidays, a copy of which is
attached hereto marked Exhibit'A and incorporated, herein by

PURPOSE . .

To establish City Council policy regarding certain special
~'eaves: of absence for full-time City employees. Additional
de%ails of such leaves of absence are 'contained in the City
Personnel Resolution.
POLICY
1. Military Leave
A. A member of the National Guard or Military Reserve ordered
to annual military duty, excluding routine drill periods,
o
and who has not less than one. year of City service, shall
:receive full salary as provided in' the State of'Cal-'ifornia
Military and Veteran's Code, for a' peri'od not to exceed
thirty (30) calendar days per year.
B. An employee with ].ess than one year of service shall
receive, one-twelfth (1/12) of the amount of City salary
that would have been received for the like period of time
covered by military leave, for each month of completed
City service.
C. Except for holidays occurring ·during the leave period,
employees on military leave are not subject to loss of
any emPloyee rights such as accrual-of vacation and si~k
leave credit., seniority, and other privileges.
2. __Jury Duty ..
A. All employees below the Department Head level will be
expected to serve on jury duty when summoned.
B. Request for exemption will be r'equested for Department
Head or above, or in the case of an emp]..oyee whose absence
would cause extreme t~ardship ~o the Cit~ as may be
determined by the City Administrator.
C. An employee on jury' duty will receive full City salary.
All checks made to the employee from the County or court,
except for mileage and subsistence reimbursements will
be endorsed over to the City.

3. Holiday Leave

A. Saturdays and Sundays, the. following days, and all other
:. ~days as may be declared by the Pres iden%, Governor, or
· the City Council as a public fast, thanksgiving, or
holiday are hereby established as holidays for regular

B. When a h'oliday occurs on a Sunday, the following Monday
will be observed. When a holiday occurs on a Saturday,
the preceding Friday will be observed.
C. 'Equivalent holiday credit procedure for Police and Fire
personnel is .contained in the Personnel Resolution.
4. Bereavement Leave
Up to five (5) days bereavement leave will be granted against
sick leave credits for an employee absent due to serious
illness or death of father, mother, brother, sister, wife,
husband, or child. Bereavement leave requested by an employee
for persons other than stated above may be ~pproved by the
City Council, when recommended by the City Administrator.
5. Other Leaves of Absence'
A. Members of the City Council,. Boards or Commissions who
intend to be absent front regularly scheduled meetings
or appointments of their respe'ctive bodies, will notify
the Mayor or Chairman, as appropriate, either directly
or through the City Clerk or Secretary. The person
so notified will insure a quorum for meetings to be held,
or inform the public body of a lack of quor~m~ in advance.

B... Leaves of absence for the City A~inistrator of three (3)
" days or less will be approved by the Mayor; over three
(3) days requires approval by the' City Council.
C> Leaves of absence for Department Heads and for
other employees in excess of three (3) days duration
mus~ be approved by the City Administrator. Depar%-
m.ent Heads will approve employee leaves of three (3)
days or less.
D. Ail .leaves of absence of any of the above p~rsons in
