NEW EASEMENT FOR INGRESS, EGRESS, ACCESS, AND PUBLIC
UTILITY PURPOSES (TRACT 16481, PROSPECT VILLAGE, LP)
SUMMARY
The proposed lot line adjustments, quitclaim of an existing easement for ingress, egress,
access, and public utility purposes from the City of Tustin to the property owner; and the
granting of a new easement for ingress, egress, access, and public utility purposes to the
City of Tustin are being requested by Prospect Village, LP to move existing lot lines to
accommodate alterations that were made during the final stages of project design and
construction.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 08-74 approving Lot Line
Adjustment No. 2008-01 and Lot Line Adjustment No. 2008-02. It is also recommended that
the City Council approve the Quitclaim Deed to Prospect Village, LP, accept an easement
for ingress, egress, access, and public utility purposes, and authorize the Mayor and City
Clerk to execute the Quitclaim Deed and accept the easement on behalf of the City.
FISCAL IMPACT
None.
BACKGROUND
Prospect Village, LP has requested lot line adjustments between Lots 2, 3, 4, 5, 6, 7 and Lot
"A" of Tract Map No. 16481. The proposed adjustments in the property lines will accommodate
alterations that were made during the final stages of project design and construction. Since the
existing easement for ingress, egress, access, and public utility purposes shown on Tract Map
No. 16481, covers Lot "A" of said map in its entirety and the lot line adjustments will alter the
dimensions and configuration of Lot "A",anew easement for ingress, egress, access, and
public utility purposes needs to be established.

DISCUSSION
Lot line adjustments are provided for in Section 66412(d) of the California Subdivision Map Act.
In that Section, the Act provides for local authorities to approve lot line adjustments where land
taken from one lot/parcel is added to an adjacent lot/parcel, and where a greater number of
lots/parcels than originally existed are not created.
The attached lot line adjustment documents, consisting of the applications and Resolution No.
08-74, will provide for the requested adjustments once Resolution No. 08-74 has been adopted
by the City Council and the Lot Line Adjustment Applications have been recorded at the
Orange County Recorder's Office.
The Lot Line Adjustment Applications have been reviewed by the Community Development
Department and the Public Works Department/Engineering Division. The proposed
adjustments have been determined to be in compliance with all zoning requirements of the
City, the provisions of the California Subdivision Map Act, and the California Environmental
Quality Act.
The subject Quitclaim Deed includes a legal description and plat of the easement for ingress,
egress, access, and public utility purposes to be quitclaimed to the property owner, Prospect
Village, LP. The easement area covers all of Lot "A" of Tract Map No. 16481, which will no
longer be a legal lot once Lot Line Adjustment No. 2008-01 and Lot Line Adjustment No. 2008-
02 are recorded. The City Attorney has reviewed the Quitclaim Deed and has signed it
"Approved as to Form".
A new easement for ingress, egress, access, and public utility purposes will then be accepted
and recorded after the subject Quitclaim Deed is recorded. The new easement area will cover
Parcel "A" of Lot Line Adjustment No. 2008-02 in its entirety.

RESOLUTION NO. 08-74
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, APPROVING LOT LINE ADJUSTMENT NO. 2008-01 AND LOT
LINE ADJUSTMENT NO. 2008-02
WHEREAS, Section 66412(d) of the California Subdivision Map Act makes
provisions for a local agency to approve lot line adjustments where the land taken from
one parcel is added to an adjacent parcel and where a greater number of parcels than
originally existed is not thereby created; and
WHEREAS, the City Council of the City of Tustin has reviewed Lot Line Adjustment
No. 2008-01 and Lot Line Adjustment No. 2008-02 and has made findings that the real
property, described in Exhibit A and shown on Exhibit B, respectively, comply with the
provisions of the California Subdivision Map Act and applicable City of Tustin ordinances
and regulations including the requirements for building sites; and
WHEREAS, the City Council of the City of Tustin has made the following findings:
1. That the proposals are eligible for processing as lot line adjustments pursuant to
Section 66412 (d) of the California Subdivision Act;
2. That the requirements of the California Environmental Quality Act have been
met;
3. That the proposals are consistent with the City of Tustin General Plan; and
4. That the resultant parcels will meet the requirements of the City of Tustin Zoning
Code;
NOW, THEREFORE, BE IT RESOLVED that the proposed Lot Line Adjustment
No. 2008-01 and Lot Line Adjustment No. 2008-02 as shown on Exhibits A and B,
respectively, are hereby approved and that the parcels be considered building sites upon
recordation of these documents.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 4th day of November 2008.
