does hereby resolve as follows'
· That Council Policy No. 90-3, relative to program
recommendations from Commissions and other groups, a copy of
which is athached hereto marked Exhibit A and incorporated
herein by this reference, is hereby approved and adopted and

incorporate¢~ in ~he Council Policy. Manual.
PASSED AND ADOPTED at a regular meeting of the City
Council of the City of Tustin, California, held on the 20th
day of May 1968.

To establish policy and procedures regarding programs and projects'

which are'requested by City Conunissions, boards, committees, or
other groups appoin-ked by the City Council.
BACKGROUND
Policies and programs for the government of the City are established
by the City Council, but there are several areas in which the
"advice of qualified citizens is highly desirable'. It is 'in these
areas ~hat the City Council has established advisory bodies, and
members are appointed because of their ~nown integrity and civic
interests.

When a commission, board, or committee is established by the Council,
the duties.of that organization may be specified in an ordinance or I!
resolution. As a matter of implied understanding, the advisory
agency is limited %o consideration of those matters which are
specifically assigned to its jurisdiction. Advisory bodies must
be forever cognizant'that the authority for making decisions on the
various recommendations is vested in the City Council, which is
chosen by the voters to evaluate the overall needs of %he
co~munity.
POLICY
The authority and responsibility for public policy and programs
rests with the City Council, therefore the role of advisory bodies
is to assist the City Council in the .formation of such policy and
programs by making recommendations and being guides to public
opinion; the City J.s thereby assuring citizen participation in
the affairs of government. ·

RELATIONSHIPS" TO STAFF
The well-recognized principle of unity of conunand renders it '
improper for advisory bodies to attempt to exercise administrative
authority or attempt to direct the par~icu.lar activities of the
City staff. ·
Staff personnel are assigned by the City Administrator to assist
~ and act in a technical advisory capacity to the representative '
commissions or boards. The staff member serves, the commission or
board in a Similar relationship as the commission or board 'serves
the City Council, but the major distinction between the relation-
: ships of a board or commission to the City Council and of a staff

member to the board/colmmission' is in tile dual responsibility of
the staff member. The staff member is directly responsible to
and under the authority of the 'City Administrator. The staff.
member i~ assigned to provide technical guidance, but he is also
at liberty to make recommendations to the. Council through the
City Administrator, which may be counter to those of the commission
or board.
ADVISORY BODY ACTIVITIES
Under normal pr'ocedures, any business transacted with the Council
by the advisory body shall be through the Chairman %o the full
City Council.

It is incumbent upon the Chairm~n to ascertain the responsibi].ities
of his organization and to limit discussion and recommendations to
the appropriate assigned areas. When commission interest spans
into an area beyond its jurisdiction, the Chairman should direct
the organization back to the assigned purpose.
PROCEDURE FOR SUBMITTING PROGRkb{S
. 1. City commissions, boards, and committees' shall be.'afforded the
opportunity to recommend and/or request various programs and pro-
jects for implementation by the Ci.%y. Such organizations may.
advise or make recommendations to the City Council, but these
advisory bodies do not have admini'strative authority or responsi-
bility over the City staff for implementation of. programs or
projects.
2. Recommendations or requests should, where possible, be sub-
mitred %o the City Administrator to 'coincid. e with the preparation
Qf the annual City budget, for consideration by th'e City .Council.
3. Programs and projects not included in the preliminary budget
prepared by the City Administrator should, if it is so desired by
the various requesting bodies, .be submitted to the City Council
for their consideration for inclusion in %he budget before
adoption.

4. Matters. contained in %he final adopted budget of the City will
be implemented by City personnel without further review by the .
Council, unless otherwise directed by %he Council or required by
State or City law. '

5. During the year, requests for additional programs or p.rojects.
which are desired but are not contained in th'e final budget, must
be submitted first to the City Council for their approval, before
consideratiOn and implementation by City personnel.. Such requests
should normally be of an emergency nature.
EXCEPTION
Nothing in this policy shall supersede or eliminate other regulations
o~ requirements which are contained in the Government Code and the
laws of California, or City laws, policies, and directives as they
. affect the- activities of commissions, boards, committees, or other
groups.;
