HUSTON, CITY MANAGER COMMUNITY DEVELOPMENT DEPARTMENT SCAG DISTRICT 17 VACANCY Agenda Item 14 Reviewed: I / City Manager ~/ Finance Director NIA The District 17 seat on the Southern California Association of Governments (SCAG) Regional Council and the Orange County Council of Governments (OCCOG) Board of Directors is vacant and open for declarations of candidacy. The District representative will represent the cities of Orange, Tustin, and Villa Park on the SCAG Regional Council for the remainder of the existing term (through May 2009) and on the OCCOG Board of Directors. RECOMMENDATION:. That the City Council appoint a candidate to fill the SCAG District 17 vacancy and direct staff to prepare a declaration of candidacy on behalf of the appointed candidate. FISCAL IMPACT: There are no significant fiscal impacts associated with declaring candidacy and/or filling the SCAG District 17 vacancy. BACKGROUND AND DISCUSSION: The District 17 seat on the Southern California Association of Governments (SCAG) Regional Council and the Orange County Council of Governments (OCCOG) Board of Directors is vacant and open for declarations of candidacy. The District 17 seat represents the cities of Orange, Tustin, and Villa Park on the SCAG Regional Council and the OCCOG Board of Directors. Mayors and/or Council Members from SCAG member cities in District 17 are eligible to seek the District 17 seat. Currently, the City of Tustin is the one SCAG member city in District 17. Council members from the cities of Orange and Villa Park may become eligible candidates if their respective city becomes a SCAG member city by December 12, City Council Report SCAG District 17 Vacancy December 2, 2008 Page 2 2008. Otherwise, the Tustin City Council's candidate to the District 17 seat will automatically serve as the District 17 representative, in accordance with SCAG election procedures. The District representative will represent the three cities on the SCAG Regional Council for the remainder of the existing term (through May 2009) and on the OCCOG Board of Directors. In Tustin, mayoral appointments to regional, County, City, and special district boards and committees are generally assigned in January of every year. However, declarations of candidacy for the SCAG District 17 seat must be received by the OCCOG Interim Clerk of the Board by letter, fax, or email by 5:00 p.m. on Friday, December 12, 2008. Council members from the cities of Orange and Villa Park can become eligible candidates for the District 17 seat, if these respective cities become a SCAG member city by Friday, December 12, 2008. If the cities of Orange and Villa Park are not SCAG member cities by Friday, December 12, 2008, the City of Tustin City Council's candidate to the District 17 seat will automatically be the District 17 representative to the SLAG Regional Council and the OCCOG Board of Directors, in accordance with SCAG election procedures. District 17 Special Election Notice Page 2 Special Election Process: The District 17 election is a two-step process. An election notice is attached that details the election process, its deadlines, and how nominations shall be submitted. If there is only one eligible candidate for the District 17 seat, that individual shall be declared the SCAG District 17 Representative without having to conduct an election. Only those city council members from SCAG member cities in District 17 are eligible to declare candidacy. If more than one eligible candidate is declared for the District 17 seat, OCCOG will announce all declared candidates to all cities in District 17 during the week of December 15, 2008. Elections will be held on Thursday, January 8, 2009 immediately before the General Membership meeting of the League of California Cities, Orange County Division. Only -those city council members from SCAG member cities in District 17 are eligible to vote in the District 17 election.
