December 8, 2008 City of Tustin Planning Commission 300 Centennial Way Tustin, CA 92780 Subject: Variance (VAR) 08-001 Dear Members of Planning Commission, The following is being offered to you, for your consideration, regarding the subject above. In reading the OFFICIAL NOTICE OF PUBLIC HEARING, there are conditions having to do with the granting of Special Privileges and the Deprivation of the Subject Property of privileges enjoyed by others in the community. All of the following is basically addressed to these two issues. With regards to: Granting of Special Privilege inconsistent with the limitation upon other properties in the vicinity and district..... etc. A. The ordinance is presumed to have been written to control sizes of properties in the Historical District. B. Granting of a variance will set a precedent or reinforce future requests for variances, all of which are in conflict with the basic ordinances intent. C. We do not believe that the variance issue causes Deprivation for this applicant. Many properties within the Historical District exceed the 20 foot height restriction. Most, if not all such properties, existed and predate the ordinance. The following are comments regard the design of the structure which is the subject of the Variance Application. We understand that this variance is for the violation of the height restrictions, which is imposed by the city ordinances. The addition of 4 feet to the height of the building has very little impact on us, Mr. Ferguson's neighbors. The greater impact would be on the residents of Tustin Commons (condominium project immediately to the north of the applicants property). Our major concern is the design of the structure itself, as it relates to the housing inventory of the Historical District. The design, as presented, is completely and totally inconsistent with the adjacent existing residence (the Victorian residence on the property), in detail character and style. We would direct your attention to the attached color photos of the existing residence detail and character. Also attached is a comparative listing of design elements between the EXISTING RESIDENCE and the BARRAGE/GUEST ROOM. As we have previously stated we are in support of Mr. Ferguson's effort to construct a Garage. Our main concern is that the design of the structure utilizes motifs and characteristics which are inconsistent with the building inventory within the Historical District. Our assessment is that the application does not recognize those quality and motifs which are within the Historical District.
