HomeMy WebLinkAboutCC RES 923RESOLUTION NO. 923 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING COUNCIL POLICY NO. 20-11, RELATIVE TO CONFLICT OF INTEREST The City Council of the City of Tustin, California, does hereby resolve as follows-. That Council Policy No. 20-11, relative to conflict' of interest, a copy of which is attached hereto marked Exhibit A and incorporated herein by this reference, is hereby approved and adopted and incorporated in the Council Policy Manual. ~ . To establish conditions and limits under which City employees may engage in outside employment or enter- prise. 2. TO prevent criticism or liability arising from. dual employment or enterprise which would conflict with an employee's responsibilities and obligations to the City, reflect criticism or discredit on an employee of the City, or affect the efficiency of any employee in the performance of his municipal duties. POLICY It is the policy of the City that no City employee shall engage in any outside employment activity or enterprise which is unsuitable or in conflict with his duties, functions, or responsibilities as a City employee, nor shall he engage in any activity which will directly or indirectly contribute to the lessening of his effectiveness as a City employee. PROCEDURE 1. An employee wishing to engage in an occupation or outside activity for compensation shall inform the City Administrator of such desire through his depart- ment head, stating the nature of the activity, the time required, and such other information as may be needed to determine whether the activity is compatible with City employment. '2. In making a determination as to the acceptability of the outside activities or. occupation, the City Admin- istrator shall consider among other pertinent factors whether the activity: , (a) Involves acceptance by the employee of any money or other consideration for the performance of an act which the employee would be expected to render as a regular part of his duties as a City employee; (b) Involves the performance of an act outside City employment which may later be subject to the control, audit, inspection, or enforcement of that employee or the department by which he is employed; CITY OF TUSTIN, CALIFORNIA .............. Resolu%ion No' 923 O,a~'e' 1/15/68 Page' 2of 3 (c) Involves conditions which would probably lessen the efficiency of an .employee in his regular City employ- ment or provide conditions of substantial danger of injury or illness; (d) Invol'ves the use for private gain or advantage of City time, facilities., equipment and supplies, prestige or influence of one's City office or employment. :,. 3. In Compliance with the stated purpose of. this policy, the City Administrator may permit employment in any or all of the following activities: (a) To teach, in an accredited educational institution, subject matter courses which are in keeping with the employee's official duties; (b) To appear as an expert witness in .appropriate legal proceedings; (c) To perform incidental work in connection with owner- ship of rental or agricultural 'property; (d) Any other employment which the City Administrator may determine is not in confl'ict with this policy. ' 4. Activities which do not 'require approval of the City Administrator or department head in compliance with this · policy include: (a) Services for a non-profit or charitable org'aniza%ion from which the employee will not gain remuneration : or economic benefit in any form; (b) Active duty in the organized reserve or national guard of the armed forces of the United States government; (c) DUty as a juror. 5. No City owned, equipment, autos, tools, trucks, supplies or any other item shall be used bY any employee while' the employee is engaged in any outside employment or activity. · CITY OF TUSTIN, CALIFORNIA Subject: COUNCIL POLICY · · ..
