RESOLUTION NO. 921
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, OF INTENTION TO ABANDON AND
VACATE A PORTION. OF A PUBLIC STREET ON BROWNING
AVENUE, BETWEEN WALNUT AVENUE AND NAVY WAY, IN
THE CITY OF TUSTIN, CALIFORNIA.
The City Council of 'the City of Tustin, California, does :
resolve as ~ollows:
I
1. That the City Council deems that th(., best interests
of the public require that a portion Of a public street on Browning ~
,.
Avenue, between Walnut Avenue' and Navy Way, in the City of Tustin, '
described in Exhibit A, attached hereto and made a part hereof a.s

though Bet forth in full, be closed to public use, abandoned and

vacated by the City, and that ISaid portion o£ a public street is
unnecessary for present or prospeCtive street use, all subject how-
ever to the reservation of a permanent easement and right at any
·
time, and from time to time, to construct, maintain, operate, repla e,
remove and renew sanitary sewers and storm drains and appurtenant
structUres in, upon, over and across said street 'or part thereof,
and pursuant to any existing franchises or renewals thereof of
otherwise to construct, maintain, operate, replace, remove a~d renew
and enlarge lines of pipe, conduits, cables, wires, poles and other
convenient structures, equipment and fixtures for the operation of
gas pipe lines, telegraphic'and telephone lines, railroad lines and
for the transportation or distribution of electric energy, petroleum
and its products, ammonia, water and.incidental purposes,' including
access and the right to keep .the property free from inflammable.
materials and wood growth and otherwise protect the same from all
hazards in, upon and over said street or part thereof.
2. That a copy of this Resolution shall be published in
a newspaper of general circulation in the City of Tustin and a
notice of the hereinafter mentioned hearing shall be duly posted

at intervals of not more than 300 feet in the area to be abandoned,
~i and in any case not less than three (3)such notices shall be posted

and said posting and publication shall be made not' less than ten (10')

days prior to. the date of the hereinafter mentioned .public hearing.

NOW, THEREFORE, BE' IT RESOLVED, that'it .iS the intention

and vacate the above-described portion of public Street of the City
of Tustin, California, subject to the foregoing reservations, and
that on the 5th .day of February , 1968, at the hour of 7 ~30 P M ,
the City Council hold a public hearing in the council chambers of
the City of Tustin for the purpose of hearing all persons interest~d'
in or objecting to the proposed vacation and abandonment; and after'
said hearing 'to make its Order according to its findings from all
the evidence submitted, whether or not said street is necessary for.
present or prospective street uses.

PASSED AND ADOPTED by the City' Council of the City of

Tustin, at a regular meeting held on the 2nd day of January,
1968.

That portion of Browning Avenue between Walnut Avenue
and Navy Way more particularly described as:
A strip of land 66.00 feet wide, the c.enterline of
which is described as follows:
Beginning at the Easterly corner of Lot 52,' .... Block 11
of Irvine's Subdivision, as shown on a map thereof
recorded in Book 1, Page 88, Miscellaneous Record
Maps., in the office of the County Recorder of Orange
County, California, said Easterly corner also being ·
the Northerly corner 'of Lot 53, Block. 45 of said Irvine's
Subdivision, said Easterly and Northerly corners also
being the intersection of the centerlines of Wal.nut
Avenue and Browning Avenue;
thence turning southwesterly along the South-
easterly line of said Block 11 and along the northwesterly
line of Block 45 to the Southerly Corner of said Block 11
and to the WeSterly corner of said Block 45.
Excepting therefrom the Northeasterly 33.00 feet of
said Lots 52 and 53. Also excepting therefrom the
Southwesterly 50.00 feet of said Blocks 11 and 45.
