A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, APPROVING SIGN CODE EXCEPTION
92-009 TO AUTHORIZE THE DISPLAY OF TWO
TEMPORARY BANNERS UNTIL COMPLETION OF THE
FIRST STREET BRIDGE ON THE PROPERTY LOCATED AT
900 WEST FIRST STREET

The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as
follows:
A. That a proper application, Sign Code Exception
92-009, has been filed by The Revere House
Restaurant requesting an exception from the
City Code Section 9403(b) to authorize the
display of two temporary banners until
completion of the First Street Bridge on the
property located at 900 West First Street.
B. Pursuant to City Code Section 9405(c), the
request to authorize an exception to the sign
regulations at the subject property can be
supported by the following findings:
1. The proposal follows the sign size and
placement requirements listed for the
display of temporary banners in that the
proposed banners measure 30 square feet
where 32 square feet would be permitted
and will be affixed to the building and
the fence on the property.
2. The purpose of the Sign Code is satisfied
in that the duration for using the
temporary signs is the result of a
hardship beyond the control of the
business owner.
3. There are special circumstances unique to
the property in that there is extensive
Caltrans construction occurring which has
caused the closure of the First Street
Bridge disrupting the normal flow of
through traffic along First Street.
4. Granting of this exception would not have
a negative impact on the surrounding
community in that the temporary signage
will be in locations permitted by the
Sign Code.

4 5. Granting of this exception would promote
the general welfare of the community in
5 that the temporary signage could act as
an indicator that a restaurant in such
6 close proximity to the Caltrans
construction remains open, therefore, all
~ of the businesses most likely remain open
thereby providing a service to the
8 community in general.
9 C. This project has been determined to be
Categorically Exempt pursuant to the
10 requirements of Section 15311 (Class 11) of
the California Environmental Quality Act.

II. The Planning Commission hereby approves the Sign
12 Code Exception 92-009, to authorize the display of
two temporary banners until the completion of the
13 First Street Bridge on the property located at 900
West First Street, subject to conditions attached
14 as Exhibit A incorporated herein by reference.
15 PASSED AND ADOPTED at a regular Planning Commission
meeting on the 10th day of November, 1992.

CONDITIONS OF APPROVAL
SIGN CODE E%CEPTION 92-009
GENERAL
(1) 1.1 The proposed project shall substantially conform to
submitted plans date stamped November 10, 1992, on file
with the Community Development Department as herein
modified or as modified by the Director of Community
Development. In accordance with this Exhibit, the
Director of Community Development may also approve
subsequent minor modifications to plans during plan check
if such modifications are determined consistent with the
approved plans.
(1) 1.2 Sign Code Exception 92-009 approval shall be valid until
the re-opening of the First Street Bridge across the "55"
Freeway, after which time the applicant shall remove all
temporary signs.
(1) 1.3 The applicant shall be responsible for ensuring that the
temporary banners remain in good repair for the duration
of the approval period.
(1) 1.4 The developer shall hold and defend the City of Tustin
harmless for all claims and liabilities out of City's
approval of the entitlement process for this project.
