A REQUEST TO DEVIATE FROM THE LANDSCAPING REQUIREMENTS AND TO REMOVE THE USE RESTRICTIONS ON THE SITE LOCATED AT 14312 CHAMBERS ROAD. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A. That a proper application, Design Review No. 92-049, was filed on behalf of Hobie Designs, Inc., requesting approval of a deviation from landscaping requirements and remove use restrictions on the property. B. Pursuant to City Code Section 9272, of the Tustin Municipal Code, the Commission finds that the location, size, architectural features and general appearance of the proposed development will not impair the orderly and harmonious development of the area, the present or future development therein, nor the occupancy as a whole. In making such findings, the Commission has considered at least the following items: 1. Height, bulk. and area of buildings. 2. Setbacks and site planning. 3. Exterior materials and colors. 4. Type and pitch of roofs. 5. Size and spacing of windows, doors and other openings. 6. Towers, chimneys, roof structures, flagpoles, radio and television antennae. 7. Landscaping, parking area design and traffic circulation. 8. Location, height and standards of exterior illumination. 9. Location and method of refuse storage. 11. Physical relationship of proposed structures to existing structures in the neighborhood. 12. Appearance and design relationship of proposed structures to existing structures and possible future structures in the neighborhood and public thoroughfares. 13. Proposed signing. 14. Development Guildlines and criteria as adopted by the City Council. II. The Planning Commission conditionally approves Design Review 92-049 authorizing modification of the site plan and removal of deed restrictions subject to conditions at the hereto as Exhibit A. THLEEN CLANCY Recording Secretary EXHIBIT A RESOLUTION NO. 4008 CONDITIONS OF APPROVAL DESIGN REVIEW 92-049 GENERAL (1) 1.1 The proposed project shall substantially conform to submitted plans date stamped November 23, 1992, on file with the Community Development Department as herein modified or as modified by the Community Development Department Director in accordance with this Exhibit. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to any new occupancy of the site and the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Design review approval shall become null and void unless building permits are issued within eighteen (18) months of the date of this Exhibit. *** 1.4 Approval of this Design Review eliminates the need for the use and occupancy restriction imposed by Planning Commission Resolution 1538. Therefore, any and all deed restrictions limiting occupancy of the building to no more than 21 employees per shift may be eliminated, after 43 parking spaces are provided on site. A release document for this deed restriction shall be subject to review and approval of the Community Development Department and the City Attorney's office. Variance 76-6 shall be considered null and void upon completion of all site improvements. (1) 1.5 The developer shall hold and defend the City of Tustin harmless for all claims and liabilities arising out of City's approval of the entitlement process for this project. --------------------------------------------------------------- SOURCE CODES (1) STANDARD CONDITION (5) (2) EIR MITIGATION (6) (3) UNIFORM BUILDING CODE/S (7) (4) DESIGN REVIEW (8) *** EXCEPTION SPECIFIC PLAN RESPONSIBLE AGENCY REQUIREMENT LANDSCAPING GUIDELINES PC/CC POLICY Exhibit A Resolution No. 4008 Page 2 1.6 Design Review Approval 92-049 shall be for use of the subject building for 17,090 square feet of warehouse space and 5,867 square feet of office space. Any alterations to the proposed use or square footage of use areas within the building shall be subject to review and approval of the City of Tustin. 1.7 No alterations to exterior materials or colors of the subject building shall be authorized without additional design review approval by the City of Tustin. PLAN SIIBMITTAL 2.1 Prior to issuance of site improvement permits, the applicant shall: (3) A. Provide construction plans, structural calculations, and title 24 energy calculations. Requirements of the Uniform Building Codes, State Handicap and Energy Requirements shall be complied with as approved by the Building Official. B. Signage and red curbs to be provided as required by Fire Code indicating no parking in fire lanes. C. Prepare on-site improvement plans for removal and modifications of curbs, planters and irrigation on the north and south elevations of the subject building. D. Plans for revitalization, repainting and restoration of that portion of building adjacent to existing planters on north and south elevations shall be submitted to the City. E. Prepare a new pavement/drainage plan. Parking lot is to be resurfaced. F. Any utilities exclusively serving site to be undergrounded. Note on plans. G. Revised landscape and irrigation plans for modifications to planters to be consistent with approved site plan modified by Exhibit A. Exhibit A Resolution No. 4008 Page 3 H. Provide details, colors and materials for all modifications to exterior walkways which must be constructed consistent with State handicap and ADA requirements. I. Prior to any new use, a complete detailed sign program including design, locations, sizes, colors, and materials shall be submitted for review and approval of the Community Development Department. SITE PLAN (4) 3.1 The site plan shall be modified to provide 43 parking spaces. The easterly space on the north and south side property line shall be eliminated and replaced with landscaping. (1) 3.2 Preparation of plans for and construction of a minimum five (5) foot wide curb adjacent utility clear sidewalk along the Chambers Road frontage or shall enter into an agreement to construct sidewalk with the public works department. 3.3 A minimum of one(1) fifteen gallon tree and five (5) five-gallon shrubs shall be placed in each area designated for the removal of a parking space in Condition 3.1 above. Such species and location shall be reviewed and approved by the Community Development Department during plan check. FEES 4.1 In conjunction with the submittal of plans required in Condition 2.1 above, the applicant shall pay all applicable building, grading and site improvement plan check and permit fees as required by the Community Development Department. 4.2 Payment of additional sewer connection fees to the Sanitation District will be required for the added square footage of the office addition calculated at $470 per 1,0900 square feet of additional floor area.
