HomeMy WebLinkAboutCC RES 82910 1! 14 18 19 ~0 21 ~8 8O 81 RESOLUTION NO. 829 A RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE CITY COUNCIL OF THE CITY OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN, AND DESIGNATED AS "PASADENA AVENUE ANNEXATION" 'TO THE CITY OF TUSTIN AND GIVING NOTICE OF THE PROPOSED ANNEXATION BE .IT RESOLVED BY THE COUNCIL OF THE CITY OF TUSTIN: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, proceedings have been initiated by the Council of the City of Tustin, on its own motion, to annex to the City of Tustin all that uninhabited territory situate in the County of Orange, State of California, hereby deslo~nated as PASADENA AVENUE ANNEXATION described as, follows: Beginning at a point on the existing boundary of the .City of Tustin, California, as established by the Ben Bro~.m Annexation by Ordinance Number 161, passed and adopted November 20, 1961, said point being on the North line of the South one-half of 'the Northwest one-quarter of Lot "M" of the Stafford. and 2'~stin Tract, as sho~,m on'a map thereof recorded in Book 2, pages 618 and 619, Miscellaneous 'Records of Los Angeles County, California, also being the East line of Pasadena Avenue, 60 feet wide, also being the East line of that certain parcel of land described as Parcel 2,' as conveyed to the State of California"bY a deed recorded in Book .5447, 'pages 227 and 228, ~Official Records of Orange County, California; thence N. 5~39'48'' W., de- parting from said City boundary, along said East line of Parcel .2 and along said East line of Pasadena Av&nue, a distance of 269.81 feet, more or less, to the Nort~ line of the West one-half of said Lot "~"; thence S. 89~30'59'' E. along said North line, a distance of 221.57 feet, more or less, to an angle point in said city boundary, as established by the McFadden Newport ~.nexation by Ordinance Number 170, passed and adopted March 17, 1962', said ang~le point' also being the Nortl~west corner of Tract Number 42.50, as shove. on a map thereof recorded in Book 151, pages 15 and 16, Miscellaneous, Maps Records of Orange County, Califozmi~;_ thence S. 00~43'47''' W. along said city boundary and along the West line of said Tract Nu_mber 42.50, a distance of 270.27 feet, more or less, t'o an angle point in said city" boundary as established, by said .Ben Brovm ~.nexation to the Northeast corner of the South one-half of the Nord~- ' west one-quarter of said Lot "M"; thence N. 8~30'.~9" W. along .said City boundary and ~long the Nortl~ line of said South one-half of tho Northwest one-quarter of Lot '"M", a distance, of 191.47 feet, more or less, to the point of' beginning. · 2. That the City Council hereby finds and deter- mines that all of said territory is uninhabited within the meaning of Government Code Section 35303, on the date of the adOption of this Resolution, and that ssid territory is contiguous to the City of Tustin. 3. That the City Council of the City of Tustin desires to annex said uninhabited territory to the City of Tustin .for the following reasons: That the territory is con- tiguous to the City of Tustin, and its proposed annexation will contribute to and facilitate the orderly growth and development of both the City and the territory proposed to be annexed; will orovide an adequate and broader tax base for the City; will facilitate ~and contribute to the proper and orderly layout, design and construction of streets, gutters, sidewalks, sanitary and storm water 'sewers and drainage facilities, both within the City and within the' territory proposed to be annexed.; and will provide and fscilitate proper over-all planning and zoning of lmnds, and subdivision of lands in said City and said uninhabited territory, in a manner most conducive to the welfare of said City and said uninhabited territory. 4. That the Local Agency Formation Commission did, in session duly assembled, on May llth, 1966, approve said proposed annexation. 5. That July 5th, 1966, at the hour of 7:30 P..M. in the Council Chambers at Tustin Area Youth Center, 600 West Sixth Street, City of Tustln, County of Orange, State of California is hereby fixed as the time and. place when and w~ere any person 27 owning real property within the uninhabited territory above described and proposed to be annexed to the City of Tustin, and $! having any objections to the proposed, annexation, may appear before the Council of the City of Tustin, and .s'how csuse why such uninhabited territory should not be so annexed to said City of 10 16 2O 21 2~ 26 29 3O 32. Tustin; such ~Protests must be in writing, and may be filed at any time prior to the final adjournment of the hearing on'protests · and shall state the name. or names of the owner or owners of prop- erty affected, and the street address or other description 'of the property sufficient to identify it on the last equalized assess- ment roll. 6. The City Clerk of the City of ~Tustin is hereby authorized and. directed to cause a copy of this Resolution to be published at least twice, bu~ not oftener than once a week, in the Tustin News, a newspaper of general circulation published in said City of Tustin, the City to which it is proposed to annex the aforesaid, territory, and also in .the Orange DailY News, a newspaper of general circulation published outside the City of Tustin, but in the County of Orange, Calif- . ornia, the County in which is located the territory proposed to be annexed to the City of Tustin. 7. The City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory pro- posed to be annexed is.assessed in the last equalized County assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to the Clerk, and to any person who 'has filed his name and address and the designation of the lands in which he.has an interest, either legal or equitable with the Clerk. 8. In the event any land. within the territory proposed to be 'annexed is owned by a county, ,the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of the County: 9.
