HomeMy WebLinkAboutCC RES 7658O RESOLUTION NO. 765 A RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE CITY COUNCIL OF THE CITY OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN, AND DESIGNATED AS THE RICHARD B. SMITH ANNEXATION TO THE CITY OF TUSTIN, CALIFORNIA, AND GIVING NOTICE OF THE PROPOSED ANNEXATION. BE IT RESOLVED BY THE COUNCIL OF THE CITY. OF TUSTIN: 1. That, pursuant to the provisions of the Annexation of Uninhabited. Territory Act of 1939, proceedings have been initiated by the Council of th.~ City of Tustin, on its own motion, to annex to the City of Tustin all that uninhabited territory situate in the County of Orange State of California, hereby designated as "RICHARD B. SMITH ANNEXATION" and hereinafter described. That the City Council hereby finds and determines that all of said territory is uninhabited, within the meaning of Government Code Section 35303, on the date of the adoption of this Resolution, and that said territory is contiguous to the City of Tustin. Commencing at a point on existing City boundary of the City of Tustln, as per Yorba Street Annexation described, in Ordinance No. 135, said point being the southeast corner of Lot i of the Felipe Yorba Tract as shown on a map thereof recorded in Book 4, page 206, Miscellaneous Records of Los Angeles County, California; thence departing from said Tustin City boundary, N 89© 22' 45" W along the South line of said. Lot l, a distance of 390 feet, more or less, to an angle point in the existing city boundary of the City of Santa Aha as per Tustin and Fourth East Annex described in Ordinance No. NS-379; thence following along said Santa Aha City boundary N 6° 21' 22" E, a distance of 175.67 feet, to an angle point; thence continuing along said Santa Aha City boundary N 4° 55' 27" E, ~ distance of 580.04 feet, to the North line of said Lot l; thence continuing along said Santa Aha City boundary S 89~ 22' 45" E along said North line, a distance of 330 feet, more or less, to the Northeast corner of said Lot l, said corner being au angle point in said Santa Ana City boundary and. also being a point on the existing city boundary of Tustin as per said Ordinance No. 135; thence departing from said Santa Ana Cit~ boundary and following along said. Tustin City boundary, S 0 ll' 30" E along the East line of said Lot l, a distance of 752.9 feet, to the point of beginn.lng. 2. That the City Council of the City of Tustin desires to annex said uninhabited territory to the City of Tustin for the following reasons: That the territory is contiguous to the City of Tustin, and its proposed annexation will contribute to and facilitate the orderly growth and development of both the City and the territory proposed to be annexed; will provide an area for industrial development for the City of Tustin, and will provide an adequate and broader tax base for the City; will facilitate and contribute to the proper and orderly layout, design and construction of streets, gutters sidewalks, sanitary and storm water sewers and drainage facilities, both within the City and within the territory proposed to be annexed; and will provide and facilitate proper over-all planning and zoning of lands, and subdivision of lands in said City and said uninhabited territory, in a manner most conducive to the welfare of said City and said uninhabited territory. 3. That the County Boundary Commission of Orange County, Dallfornia, did, in session duly assembled, on December ?, 1964, approve the proposed annexation boundaries of the said RICHARD B. SMITH ANNEXATION to the City of Tustin, as above described, and as submitted to said Commission by the Council of the City of Tustin. 4. That March 15, 1965, at the hour of 7:30 P.M. in the Tustln Youth Center, in the City of Tustin, County of Orange, State of California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and. proposed to be annexed to the City of Tustin, and having any objections to the proposed annexation, may appear before the Council of the City of Tustin, and show cause why such uninhabited territory should not be so annexed to said City of Tustin. Such protests must be in writing, and. may be filed at any time prior to the final adjournment of the hearing on protests, and shall state the name or names of the owner or owners of property affected, and the street address or other description of the property sufficient to identify it on the last equalized assessment roll. The City Clerk of the City of Tustin is hereby authorized and directed to cause a copy of this Resolution to be published at least twice, but not oftener than once a week, in The Tustin News, a · · newspaper of general circulation published in said City of Tustin, the City to which it is proposed to annex the aforesaid territory, and also in the Orange Daily Ne~s, a newspaper of general circulation published outside the City of Tustin, but in the County of Orange, California., the County in which is located the territory proposed to be annexed to the City of Tustln, said publications to be complete at least twenty (20) days prior to the date set for hearing. 6. The City Clerk is further authorized and directed to cause written notice of such .~roposed annexation to be mailed to each person to whom land within the territory proposed to be annexed "is assessed in the last equalized County assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to the Clerk, and. to any person who has filed his name and. address and the designation of the lands in which he has an interest, either legal or equitable, with the Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. ?. In the event any land within the territory proposed, to be annexed, is owned by a county, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of the County, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. .J 8. In the event there is upon the land proposed to be annexed, a structural ~mprovement, owned being acquired or leased by a county fire protection d~strict, the sa~id Clerk ~s directed to cause written not~ce of such proposed annexation to be mailed to the governing body of such distr~ct, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 9. The City Clerk is directed to cause written notice to be g~ven to such other persons as may be legally entitled thereto, in the manner required by law.
