HomeMy WebLinkAboutCC RES 749RESOLUTION NO. 749 A RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE CITY COUNCIL OF THE CITY OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN,. AND DESIGNATED AS BRYAN-NEWPORT ANNEXATION TO THE CITY OF TUSTIN, AND GIVING NOTICE OF THE PROPOSED ANNEXATION. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TUSTIN: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, proceedings have been initiated by the Council of the City of Tustin, on its own motion, to annex to the City of Tustin all that uninhabited territory situate in the County of Orange, State of Callfornla, hereby designated as "BRYAN-NEWPORT ANNEXATION" and hereinafter described. That the City Council hereby finds and determines that all of said territory is uninhabited within the meaning of Government Code Section 35303, on the date of the adoption of thi. s Resolution, and that said territory is contiguous to the City of Tustin. Legal DescriPtion for Proposed Bryan-Newport Annexation to the City of Tustin Commencing at an anEle point to the existinE City boundary of the City of Tust~.n as per the Bryan-Red Hill Annexation described in Ordinance No. 172, said angle point being the intersection of the Northwest l~ne of Lot 17, Block 12, Irvine's Subdivision as shown on. a map thereof recorded in Book l, P~ge 88, M:i. scellaneous Maps, Records of. Orange County, California with a line parallel to and 33.00 feet Southwesterly of as measured at right angles to the Northeast llne of sald Lot 17; thence following along sald City boundsry S 50o00't[0'' E along said parallel llne, a distance of 660 feet, more or less, to the South- westerly prolongation of the Northwesterly 'l. ine of the Southeasterly half of the Southwesterly half of Lot 16, of said Block 12; thence ¢ontlnuing along said City .boundary ~ 39059'20" E along said Southwesterly prolongation, and said Northwesterly line, a distance of 693 feet, more or less, to the center of said Lot 16, said center being an angle point in said Bryan-Red Hill Annexation, said center also being an angle point in the First Street Annexation. to the City of Tustin as per Ordinance No. 204; thence following along said First Street Annexation boundary N 39°59'20'' E along the Northwest llne of the East one-quarter of said Lot 16, a distance of 660 feet, more or less, to the most Northerly corner of said East one-qu, rter, said corner also being an angle point in said. First Street Annexation boundary; thence continuing along said First Street Annexation boundary$ S 50.o00'40" E along the Northeast line of said East one-quarter a dlstance of 660 feet, more or' less to the Easterly corner. of said Lot 16, said corner also being the most Southerly corner of Lot l, of said Block 12, said corner being an angle point in said First Street Annexation boundary an~ also being a point on the boundsry of said Bryan-Red Hill Annexation; thence following along said Bryan-Red Hill Annexation boundary N 39o59'20" E along the Southeast llne of ssid Lot l, a distance of ~30 feet, more or less, to the Ea'sterly corner of the Southwest one-half of the Southwest one-half of said Lot 1; thence leaving said Bryan-Red Hill Annexation boundary line N 50°00'40'' W along the Northeast line of said Southwest one-half, a distance of 1320 feet, more or less, to a .ooint on the Northwest line of said Lot l, said Northwest line also being on the existing boundary of the City of Tustln as per the Eastslde Annexation described in Ordinance No. lll; thence following along said Eastside Aune×ation boundary S 39°57'46'' W alone the Northwest line of said Lots l, 16 and 17, a distance of 1,683 feet, more or less, to the point of beginning. 2. That the City Council of the City of Tustln desires to annex said uninhabited territory to the City of Tustin for the~ following reasons: That the territory is contiguous to the City of Tustln, and its proposed annexation will contribute to and facilitate the orderly growth and. development of both the City and the territory proposed to be annexed; will provide an area for the industr.t, al development of the City ~ T'ustln, and will provide an adequate and broader tax base for the City; will facilitate and contribute to the proper and orderly layout, design and construction of streets, gutters, sidewalks, sanitary and storm water sewers and drainage facilities, both within the City and within the territory proposed to be annexed; and will orovide and facilitate oroper over-all planning and zoning of lands, and subdivisions of lands, in said City and said uninhabited territory, in a manner most conducive to the welfare of said City and said uninhabited territory. 3. That the County Boundary Commission of Orange County, California, did, in session duly assembled, on September 28, 1964, approve the proposed annexation boundaries of the said BRYAN-NEWPoRT ANNEXATION to the City of Tustin, as above-described, and as submitted to said Commission by the Council. of the City of Tustin. , That the Local Agency Formation Commission did in session duly assembled., on November 4, 1964, approve the proposed BRYAN-NEWPORT ANNEXATION to the City of Tustin, as above-descrobed, amd as s~bmitted to said Commission by the Council of the City of Tustin. 5. That January 4th, 1965, at the hour of 7:30 P.M. in the Tustin Youth Center, in the City of Tustin, County of Orange, State of California, is hereby fixed as the time and place when and where any person owning real property within the uninhsbited territory above-described and proposed to be annexed to the City of Tustln, and hsving any objections to the proposed annexation, may appear before the Council of the City of Tustln, and show cause why such uninhabited territory should not be so annexed to said City of Tustin. Such protests must be in writing, and may be filed at any time prior to the final adjournment of the hearing on protests, and shall state the name or names of the owner or owners of property affected, and the street address or other description of the prooerty sufficient to identify it on the last equalized assessment roll. 6. The City Clerk of the City of Tustin is hereby authorized and directed to cause a copy of this Resolution to be published at least twice, but not oftener than once a week, in The Tustin News, a newspaper of general circulation published in said City of Tustin, the City to which it is proposed to annex the afore-said territory, and also in the Orange Daily News, a newspaper of general circulation published outside the City Of Tustin, but in the County of Orange, California, the County in which is located the territory proposed to be annexed to the City of Tustin, said publication to be complete at least twenty (20) day..s prior to the date set for hearing. 7. The City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last eG'ualized County assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to the Clerk , and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with the Clerk, 36 such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 8. In the event,any land within the territory proposed to be annexed is owned by a county, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of the County, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 9. In the event there is, upon the land proposed to be annexed., a structural improvement, owned, being acquired or leased by a county fire protection district, the said Clerk is directed, to cause written notice of such proposed annexation to be mailed to the go~erning body of such district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 10. The City Clerk is directed to cause written notice to be given to such other persons as may be legally' entitled thereto, in the manner required by law.
