HomeMy WebLinkAboutCC RES 748 RESOLUTION NO. 748 A RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE CITY COUNCIL OF THE CITY OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN, AND DESIGNATED AS PARKER ANNEXATION TO THE CITY OF TUSTIN, CALIFORNIA, AND GIVING NOTICE OF THE PROPOSED ANNEXATION. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TUSTIN: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, proceedings have been initiated by 'the Council of the City of Tustin, on its own motion, to annex to the City of Tustin all that uninhabited territory situate in the County of Orange, State of California, hereby designated as "PARKER ANNEXATION", and hereinafter described. That the City Council hereby finds and determines that all of said territory is uninhabited within the meaning of Government Code Section 35303, on the date of the adoption of this Resolution, and that said territory is contio~uous to the City of Tustin. Legal Description for Proposed Parker Annexation to the City of Tustin Commencing at an angle point in the existing City boundary of the City of Tustin as per the Marshall Anne×a- tion described in Ordinance No. 145 passed and adopted by the Tustln City Council on January 16, 1961, said ~ngle point being the Southeast corner of the Northwest quarter of the Northeast ~..uarter of Lot ll, Block B of the A. B. Chapman Tract as shown on a map thereof recorded in Book 102', page 15, Miscellaneous Maps, Records of Orange County, California; thence, following along said existing City boundary, N 88°57'07" W,.along the South line of said Northwest quarter, a distance of 330.00 feet, more or less, to the Southwest corner thereof; thence, continuing along said City boundary, N 0o53'02'' E, along the West line of said Northwest quarter, a distance of 272.88 feet, more or less, to an angle point in said City boundary, said angle point being the southwest corner of that certain parcel of land conveyed to the State of California per deed recorded in Book 4278, page 36.5, Official Records of Orange County, California; thence departing from sai~ City boundary, N 88o43'21'' E, along the Southerly line of said State Of California parcel, a distance of 175.84 feet, to the Southeast corner of said State of Californi~a parcel; thence N lO02'53'' E, along the East line of said State of California parcel, a distance of 30.00 feet to a point on a~llne parallel to and 20.00 feet southerly of, as measured at right anEles to, the surveyed centerline of Santa C~'ara Avenue; thence S 88o57'07" E along said parallel llne, a distance of 154.13 feet, more or less, to the East line of the Northwest quarter of the Northeast quarter of said Lot ll; thence S 0°53'02'' W along said East line, a distance of 310 feet, to the point of beginning. 2. That the City Council of the City of Tustin desires to annex said uninhabited, territory to the , City of Tustin for the following reasons: That the territory is contiguous to the City of Tustin, and its proposed snnexation will contribute to and facilitate the orderly growth and development of both the City and the territory proposed to be anne×ed; will provide an area for industrial develooment for the City of Tustin, and will provide an adequate and broader tax base for the City; will facllitiate and contribute to the proper and orderly layout, design and construction of streets, gutters, sidewalks, sanitary and storm water sewers and 'drainage facilities, both within the City and within the territory pro..oosed t0 be annexed; and will orovide and facilitate proper over-all planning and zoning of lands, and subdivision of"lands, in said City and said uninhabited territory, In a manner most conducive to the welfare of said City and. said uninhabited territory. 3. That the County Boundary Commission of Orange County, California, did, in session duly assembled, on September 28, 1964, approve the proposed annexation boundaries of the said PARKER ANNEXATION to the City of Tustin, as above-described, and as submitted to said Commission by the Council of the City of Tustin. 4. That the Local Agency Formation Commission did, in session duly .assembled, on November 4, 1964, approve the proposed PARKER ANNEXATION to the City of Tustin, as above-described, and as submitted to said Commission by th'e Council of the City of Tustln, upon condition that the drainage assessments to be p8id to the County of Orange should be paid orior to final annexation. 5. That January 4th, 1965, at the hour of 7:30 P.M. in the Tustin Youth Center, in the City of Tustin, County of Orange, State of California, is hereby fixed as the time snd place when and. where any person owning real property within the uninhabited territory above-described and proposed to be annexed to the City of Tustin, and having any objections to the proposed annexation, may appear before the Council of the City of Tustin, and show cause why such uninhabited territory should not be so annexed to said City of Tustin. Such protests must be in writing, and may be filed at any time prior to the final adjournment of the hearing on protests, and shall state the name or names of the owner or o~mers of oroperty affected, a~d the street address or other description of the property sufficient to identify it on the last equalized assessment roll. 6. The City Clerk of the City of Tustin is hereby authorized and directed to cause a copy of this Resolution to be published at least twice, but not oftener than once ~ week, in The Tustiu News, a newspaper of general circulation published in said City of Tustln, the City to which it is proposed to annex the afore-said territory and also in the Orange Daily News, a newspaper of general circulation published outside the City of Tustin, but in the County of Orange, California, the County in which is located 6he territory proposed to be annexed to the City of Tustin, ssid publication, to be complete at least twenty (20) days prior to the date set for hearing. 7. The City Clerk is further authorized ~nd directed to cause written notice of s~ch proposed annexation to be mailed to each person to whom land within the territ~ory proposed to be annexed is assessed in the last equalized County assessment roll available on the date the sbove said proceedings were in~tlated, at the addresses s~own on said assessment roll or known to the Clerk, and to any person !. who has filed his name and address and. the deslgnatio~ of the lands in which he has an interest, either legal or equitable, with the Clerk, such notice to be givem, not less than twenty (20) days before the first public hearing on the proposed annexation. 8. In the event any land within the territory proposed to be anne×ed ~s owned by a county, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of the County, such notice to be given not less than twenty (20) days before the first ~ublic hearing on the proposed. annexst ion. 9. In the event there is, upon the land proposed to be annexed, a structural improvement, owned, being acquire~ or leased by a county fire protection district, .. the said Clerk is dir~'.~cted to cause written notice of such proposed annexation to be mailed to the govern, ing body of such district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 10. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto in the manner required by law.
