HomeMy WebLinkAboutCC RES 740 RESOLUTION NO. 740 A RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE CITY COUNCIL OF THE CITY OF TUSTIN TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DES- CRIBED HEREIN, AND DESIGNATED AS REVISED SANTA CLARA ANNEXATION TO THE CITY OF TUSTIN AND GIVING NOTICE OF THE PROPOSED ANNEXATION. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TUSTIN: 1. That, pursuant to the provisions of the Annexation of Uninhablted Terrltory Act of 1939, proceedings have been initiated, by the Council of the City of Tustln, on its own motion, to annex to the City of ~astin, all' that unlnhabited territory situate in the County of Orange, State of California hereby designated, as "REVISED SANTA CLARA ANNEXATION" and hereinafter described.. That the City Council hereby finds and determines that all of said territory is uninhabited within the meaning of Government Code Section 35303, on the date of the adoption of this Resolution, and that said territo'ry is contiguous to the City of Tustln. LEGAL DESCRIPTION FOR REVISED SANTA CLARA ANNEXATION TO THE CITY OF TUSTIN COmmencing at an angle point in the existing City boundary of Tustin as established by Yorba Street Annexation No. 2 as per Ordinance NO. 139, passed and adopted by the City Council on September 6, 1960, said anEle point being the Northeast corner of Lot l, Tract No. 3465'as shown on a map thereof recorded in Book 120, pages 14 and 1.5, Miscellaneous Maps, Records of Orange County, California, said coruer being 40 feet Southerly of, as measured at right angles to, the surveyed centerline of Santa Clara Avenue; thence, departing from the existing City boundary S 89o53'55'' E. along a line parallel to and 40 feet Southerly of, as measured at right angles to the surveyed centerline of Santa Clara Avenue, a distance of 407.31 feet; thence N OO01 '00"' W. a distance of 15,00 feet, to a line parallel to and 2.5 feet Southerly of the surveyed centerllne of Santa Clara Avenue; thence S 89°53'55'' E, along said parallel line, a distance of 353 feet, more or less, to a lim. e parallel to and 25 feet Westerly of, as measured at right angles to the surveyed centerline of Prospect Avenue; thence S 3o29'15" W. along said parallel li'ne a distance of ll5 feet, more or less, to the Northerly line of that certain parcel of land as described in a deed recorded in Book 6861, page 368, Official Records of Orange County, California; thence N 89°53'55" W along said North llne, a distance of 15 feet, more or less, to a line parallel to and 40 feet Westerly of, as measured at right angles to the surveyed centerline of Prospect Avenue; thence S 3°29'15" W along said parallel line, a distance of 205.10 feet, to the Northeast corner of Lot l, Tract No. 2708, as shown on a map thereof recorded in Book 90, page 25, Miscellaneous Maps~ Records of Orange County, California; thence N 89~53'55'' W, along the North line of said Tract No. 2708, a distance of 724.38 feet, to the North- west corner thereof, said corner also being an angle point in East line of said Tract No. 3465, said corner also being an angle point in the existing city boundary an a~uexed by said Yorba Street Annexation No. 2; thence N 0OOl'00'' W, along said East line of said Tract No. 3465, also being along said existing City boundary, a distance of 304.41 feet, to the point of beginning. 2. That the City Council of the City of Tustin desires to annex said uninhabited territory to the City of Tustln for the following reasons:· That the territory is contiguous to the City of Tustin, and its proposed annexation will contribute to and facilitate the orderly growth and development of both the City and the territory proposed to be annexed; will provide an area for industrial develooment for the City of Tustin, and will provide an adequate and broader tax base for the City; will facilitate and contribute to the proper and. orderly layout, design and construction of streets, gutters, sldewslks, sanitary and storm water sewers and drainage facilities, both within the City and within the territory proposed to be annexed; and will provide and facilitate proper over-all planning and zoning of lands, and. subdivision of lands in said City and said uninhabited territory, in a manner most conducive to the welfare of said City and said uninhabited territory. 3. That the County Boundary Commission of Orange County, California, did, in session duly assembled, on July 27, 1964, approve the proposed annexation boundaries of the said REVISED SANTA CLARA ANNEXATION to the City of Tustin, as above described, and as submitted to said Commission by the Council of the City of Tustin,~ That November 2, 1964, at the hour of 7:30 P.M. in the Council Chambers, Tustin Area Yout~h~ Center, 600 W. 6th Street, City of Tustin, County of Orange, State of California, is hereby fixed aS the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Tustin, and having any objections to the proposed anne×ation, may appear before the Council of the City of Tustln, and. show cause why such uninhabited territory should not be so annexed to said City of Tustin. Such protests must be in writing, and may be filed at any time prior to the final adjournment of the hearing on. protests, and shall state the name or names of the owner or owners of property affected, and the street address or other descriPtion of the property sufficient to identify it on the last equalized assessment roll. 5. The City Clerk of the City of Tustln is hereby authorized and directed to cause a copy of this Resolution to be published at least twice, but not oftener than once a week, in The Tustln News, a newspaper of general eirculatlon published in said City of Tustin, the City to which it is proposed to annex the afore~said territory, and also in the Orange Daily News, a newspaper of general circulation published outside the City of Tustln, but in the County of Orange, California, the County in wh~i. ch is located the territory proposed to be annexed to the City of TUstin, said publication to be complete at least twenty (20) days prior to the date set for hearing. 6. The City Clerk is further authorized and directe8 to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized County assessment roll available on the date the above said proceedin~s were initiated, at the addresses shown on said assessment roll or known to the Clerk, and. to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with the Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed anne xa t i on. 7. In the event any land within the territory pro- posed to be annexed is owned, by a county, the City Clerk is directed to cause written notice of such porposed annex- ation to be mailed to the Board of Supervisors of the County such notice to .be given not less than twenty (20) days before the first public hearing on the proposed annexation. 8. In the event there is, upon the land proposed to be annexed, a structural improvement, owned, being acquired or leased by a co~nty fire protection district, the said Clerk is directed, to cause written, notice of such proposed annexation to be mailed to the governing bOdy of such district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 9. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner ~require~ by law.
