A RESOLUTION DECLARING THAT PROCEEDINGS HAVE
BEEN INITIATED BY THE CITY COUNCIL OF THE
CITY OF TUSTIN TO ANNEX TO SAID CITY CERTAIN
UNINHABITED TERRITORY DESCRIBED HEREIN, AND
DESIGNATED AS BRYAN-RED HILL ANNEXATION NO. 2
TO THE CITY OF TUSTIN, AND GIVING NOTICE OF
THE PROPOSED ANNEXATION.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TUSTIN:
1. That, pursuant to the provisions of the Annexation
of Uninhabited Territory Act of 1939, proceedings have been initi-
ated by the Council of the City of Tustin, on its own motion,
to annex to the City of Tustin all that uninhabited territory
situate in the County of Orange, State of California, hereby
designated as "BRYAN-RED HILL ANNEXATION NO. 2" and hereinafter
described.
That the City Council hereby finds and determines
that all of said territory is uninhabited within the meaning
of Government Code Section 35303, on the date of the adoption
of this Resolution, and that said territory is contiguous to
the City of Tustin.
LEGAL DESCRIPTION FOR PROPOSED
BRYAN-RED HILL ANNEXATION NO.2
TO THE CITY OF TUSTIN, CALIFORNIA
Commencing at an angle point in the existing Tustln
City boundary as described ~.u the Bryan-Red Hill Annexation as
per Ordinance No.172, passe~ and adopted on June 4, 1962, said
angle point being 50 feet Northwesterly of, as measured at right
angles to, the surveyed center l~.ne of Red Hill Avenue and being
on the Northeast line of the Southwesterly 93 feet of the South-
easterly 210 feet of the Northeasterly 440 feet of the South-
easterly 495 feet of Lot 15, Block 12, Irvine's Subdivision as
shown on a map thereof recorded in Book l, Page 88, Miscellaneous
Maps, Records of Orange County, .California;
Thence, following along said existing City boundary,
the following courses and distances:'
N~ 50°00'40" W., along the Northeast line of said
Southwesterly 93 feet, a distance of 160 feet to
the most Northerly corner of said Southwesterly
93 feet;
Thence, S. 39054'30'' W. along the Northwes~ line
of said Southwesterly 93 feet and along the Northwest line of
.the Northeasterly 93 feet of the Southeasterly 210 feet of the
Northeasterly 440 feet of the Southeasterly 495 feet of the
Southwesterly 880 feet of said Lot 15, a distance of 186 feet
to the most Westerly corner of said Northeasterly 93 feet;
Thence, S. 50°00'40" E. along the Southwest line of
said Northeasterly 93 feet, a distance of 160 feet to a line
parallel to and 50 feet Northwesterly of as measured at right
angles to the surveyed center line of Red Hill Avenue.

distance of 347 feet to the Southwest line of the Northeast
440 feet of the Southeast 495 feet of the Southwest 880 feet
of said Lot 15;
Thence, N. 50°00'40'' W. along said Southwesterly line,
a distance of 445.68 feet to a point on the Sofltheasterly
line of Lot 3 of Tract No. 4331, as shown on a map thereof
recorded in Book 156, Pages 7 and 8, Miscellaneous Maps,

Thence, S. 39055'03'' W. along the Southeasterly line
of said Tract 4331, a distance of 400.00 feet t.o the Southerly
corner of Lot 8 of said Tract 4331, said corner being on a
line parallel to and 40 feet Northeasterly of as measured

distance of 225.29 feet to the Northeasterly prolongation

Thence, S. 39°54' 57" W., along said Northeasterly
prolongation and said Southeasterly line, a distance of 190 feet

on the Northeasterly line of Lot 31 of said Tract No. 4334;
Thence, S. 50°00'31" E. along said Northeasterly line,
a distance of 60.00 feet, to the most Easterly corner of said
Lot 31;
Thence, S. 39o54'57" W. along the Southeast line of

Northerly corner of Tract No. 4317 as shown on a map thereof

Tract No. 4317 and the Southeasterly prolongation thereof, a
distance of 711.11 feet to the Northwest line of Lot 3 of
Tract 4418 as shown on a Map thereof recorded in Book 154,

50 feet Southeasterly of as measured at right angles to the

Thence, N. 39°54'12" E. along said parallel line, a
distance of 26.3.28 feet to the intersection of a tangent

curve being the Northerly llne .of Lot 7 of said Tract No. 4418.
Thence, Northeasterly, Easterly and Southeasterly alone
said curve through a central angle of 90°06'01", an arc
distance of 42.46 feet to the intersection of a tangent line
parallel to and 40 feet. Southwesterly of as measured at right
angles to the surveye~ centerline of Bryan Avenue;
Thence, S. 49°59'47" E., along said parallel line, a
distance of 583.27 feet, more or less, to the Southwesterly
prolongation of the Southeasterly line of Tract No. 4756 as
shown on a. map thereof recorded in Book 198, Pages 41 and
42, Miscellaneous Maps, Records of Orange County, Californ.2a;
Thence, departing from said existing City boundary, N.
39o54'50" E., along said Southwesterly prolongation and along
said Southeasterly line of Tract No. 4756, a distance of 700.48
feet, to the most Easterly corner of said Tract No. 4756.
Thence, N. 50°00'00'' W., along the Northeast line of
said Tract No. 4756, a d. istsnce of 610.32 feet to a line
parallel to and 50 feet Southeasterly of as measured at
right angles to, the surveyed centerline of Red Hill Avenue.
Thence, N. 39o54'30'' E., along said parallel line, a
distance of 312.52 feet, to the Southeasterly prolongation
of the afore-mentioned Northeast line of the Southwesterly
93 feet of the Southeasterly 210 feet of the Northeasterly
440 feet of the Southeasterly 495 feet of said Lot 15;
Thence, N. 50°00'40'' W. along said Southeasterly
prolongation, a distance of lO0,00 feet to the point, of
beginnlng.
2. That the City Council of the City of Tustin desires
to annex said uninhabited territory to the City of Tustin for
the following reasons: That the territory is contiguous to the
City of Tustin, and its proposed annexation will contribute to
and facilitate the orderly growth and development of both the
City and the territory proposed to be annexed, will provide an
adequate and' broader tax base for the City; will facilitate and
contribute to the proper and orderly layout, design and construc-
tion of streets, gutters, sidewalks, sanitary and storm water
sewers and drainage f~cilitles, both within the City and within
the territory proposed to be annexed; and will province and
facilitate proper over-all planning and zoning of lands, and
subdivision of lands in said City and said uninhabited territory,
in a manner most conducive to the welfare of said City and said
uninhabited territory,
3. That the County Boundary Commission of Orange County,
California, did, in session duly assembled., on July 27, 1964,
approve the proposed annexation boundaries of the said BRYAN-
RED HILL ANNEXATION NO. 2 to the City of Tustin, as above
described, and as submitted to said Commission by the Council
of the City of Tustin.
4. That November 2nd, 1964, at the hour of 7:30 P.M.
in the Council Chambers, Tustin Area Youth Center, 600 W. 6th St.
City of Tustin, County of Orange, State of California, is hereby
fixed as the time and place when and where any person owning
real property wi thin the uninhabited territory above described
and proposed to be annexed to the City of Tustin, and having
any objections to the proposed annexation, may appear before
the Council of the City of Tustin, and show cause why such
uninhabited territory should not be so annexed to said City of

Tustino Such protests must be in. writing, and may be filed
at any time prior to the final adjournment of the hearing on
protests, and shall state the name or names of the owner or
owners of property affected, and the street address or other
description of the property sufficient to identify it on the
last equalized assessment roll.
5. The City Clerk of the City of Tustin is hereby
authorized and directed to cause a copy of this Resolution
to be published at least twice, but 'not oftener than once
a week, in The Tustin News, a newspaper of general circulation
published in said City of TustIn, the City to which it is
proposed to annex the afore-said territory, and also in the
Orange Daily News, a newspaper of general circulation published
outside the City of Tustln, but in the County of Orange,

California, the County in which is located the territory
proposed to be annexed to the City of Tustin, said publication
to be complete at least twenty (20) days prior to the date set
for hearing.
6. The City Clerk is further authorized and directed
to cause written notice of such proposed annexation to be
mailed to each person to whom land within the territory
proposed to be annexed, is assessed in the last equalized.
County assessment roll available on the date the above said
proceedings were initiated, at the addresses shown on said
assessment roll or known to the Clerk, and to any person who
has filed his name and address and. the designation of the lands
in which he has an interest, either legal or equitable, with the
Clerk, such notice to be given not less than twenty (20) days
before the first public hearing on the proposed annexation.
7. In the event any land. within the territory pro-
posed to be annexed is owned, by a county, the City Clerk
is directed to cause written notice of such proposed annex-
ation to be mailed to the Board of Supervisors of the County,
such notice to be given not less than twenty (20) days before
the first public hearing on the proposed annexation,
8. In the event there is, upon the land proposed to
be annexed, a structural improvement, owned, being acquired
or leased by a county fire protection district, the said
Clerk is directed to cause written notice of such proposed
annexation to be mailed to the governing body of such
district, such notice to be sent not less than ten (10)
days before the first public hearing upon such proposed
annexation.
9. The City Clerk is directed to cause written
notice to be given to such other persons as ~ay be legally
entitled thereto, in the manner required by law.
PASSED AND ADOPTED at a meeting of the City Council
of the City of Tustin, 8th day of September,
1964.
