RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CLAIFORNIA INTENTION TO ABANDON AND VACATE A PORTION OF A PUBLIC STREET AT FIRST AND NEWPORT AVENUE IN THE CITY OF TUSTIN, CALIFORNIA. The City Council of the City of Tustin, California, do.~s resolve as follows: 1. That the City Council deems that the best interest of the public require that a portion of a public street at First and Newport Avenue in the City of Tustin, described, in Exhibit A, attached hereto and made a'~'~part hereof as though set forth in full, be closed to public use, abandoned and vacated by the City,. and that said portion of a public street is unnecessary for present or prospective street use, all subject however to the reservation of a permanent easement and right at any time, and from time to time to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across said street or part thereof, and pursuant to any existing franchises or renewals thereof or otherwise tc construct, maintain, operate, replace, remove and renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structUres, equipment and fixtures for the operation of.gas pipe lines, telegraphic and telephone lines, railroad lines and for the transportation or distribution of electric energy, petroleum and its products, ammonia, water and incidental purposes, including access and the right to keep the property free from inflammable materials and wood growth and otherwise protect the same from all hazards in, upon and over said street or part thereof. 2. That a copy of this Resolution shall be i~bliched in a' newspaper of general circulation ~.n the City of Tustin and a notiCe of the hereinafter mentioned hearing shall be duly posted at intervals of not more than 300 feet in the area to be abandoned, and in any case, not less than three. (3) such notices shall be posted, and said posting and publications shall be made not less than ten (10) days prior to the date of the hereinafter mentioned publ i c hearing. 3. That a map of said public street and the area proposed to be vacated and abandoned is on file in the office of the City Clerk and reference may be made thereto; NOW, THEREFORE, BE IT RESOLVED, that it is the intention of the City Council of the City of Tustln, California to abandon and vacate the above described portion of public street of the City of Tustln, California, subject to the foregoing reservations, and that on.the 3_rd~ day of _AuEust, 1964, at the hour of 7:30 P.M. the City Council hold a public hearing in the council chambers of the City of Tustin for the purposes of hearing all persons interested in or objecting to the proposed vacation and abandonment; and after said hearing to make its Order according to its findings from all the evidence submitted, whether or not said street is necessary for present or prospective street, uses.
