HomeMy WebLinkAboutCC RES 718RESOLUTION NO. 718 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN., CALIFORNIA, RECITING THE. FACT OF THE SPECIAL MUNICIPAL ELECTION HELD IN SAID CITY OF TUSTIN ON THE 12th DAY OF MAY, 1964, DECLARING THE RESULT THEREOF, AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW. WHEREAS, a special municipal election was held and conducted in the City of Tustin, County of Orange, State of California, on Tuesday, May 12, 1964, as required by law, pursuant to initiative and referendum proceedings; and WHEREAS, notice of said electl0n was duly and regularly given in time, form and manner as provided by law that voting precincts were duly es'~ablished; that election officers were appointed and that in all .respects said election was held and conducted and the votes cast thereat received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Election ~ode of the State of California for holding of special elections in ~eneral law cities; and WHEREAS, on the 19th day of May, 1964, at the hour .of 7:30 P.M. the City Uouncll duly assembled at the Old Council Chambers of the City Hall, 145 W. Third Street, Tustin California, and canvassed the returns of said election, and as a result of which the City Council finds that the number of votes cast and the ordinances voted upon and other matters required by law to be as stated hereinafter; NOW, THEREFORE, the ~ity Council of the City of Tustin, California, does RESOLVE as follows:· Section l: That there were four voting precincts established f6r the purpose of holding said election, consisting of consolidations of the regular election precincts in the City of Tustin, as established for the holding of state and county elections. Section 2: That said special municipal elections was held for the prupose of voting on the following measures, to-wit: (a) Initiative Ordinance: Shall the ordinance rezoning all property in the R-2, R-3, R-4, PD and U Zones to the R-1 Zone, and providing for suspension of certain provisions of the zoning ordinance, for one year, be adopted ? Said Ordinance states as follows: AN INTERIM ORDINANCE OF~ THE CITY OF TUSTIN TEMPORARILY ZONING CERTAIN~.~TERRITORY AS R-1 AND PROVIDING FOR AN INTERIM SUSPENSION OF CERTAIN PROVISIONS OF THE ZONING ORDINANCE OF THE CITY OF TUSTIN. The City Council of the City of Tustin does ordain as follows: Section 1. This ordinance is enacted as a temporary interim °rdlnanc~ pursuant to the provisions of Section 65806 of the Government Code of the State of California. Section 2. All territory now classified under the existing z0nin~"'0bdinance of the City ofTustin as R-2, R-3, R-4, PD and U (dupl.exes, triplexes, multiple family dwellings, apartments houses, and unclassified for any use) are hereby rezOned and reclassified as R-l' (single family dwelling) for the .period provided for in the ordinance. Section 3. Section 4 of O~dlnance 157 of the City of Tustln '--' (zoning-ordinance) is hereby amended and the provisions covering R-2, R-3, R-4, PD and U (duplexes, t~iplexes, ~_ multiple family dwellings, apartment houses and unclassified territory) provided for in Sections 4.4, 4'.5, 4.6, 4.12 and 4.15 thereof are repealed for the term provided in this ordlnance. Section 4. ~The City Council has recently employed the services of a Planning Director for the .first time in the history of the. City, and the City Council has previously requested the Planning Commission and the Department of Plannin~ to conduct hearings for t'he purpose of recommending to the ~lty Council the adoption of amendments to the zoning ordinance respecting the problems of multiple housing within the City of Tustin. The City Council finds and determines that in order to properly discharge the Council'S responsibilities concerning the planning and development of the City and to protect the public safety, health and welfarg, ~thls ordinance is necassary as a temporary interim zoning ordinance prohibiting multiple housing uses which may be in conflict with the recommendations of the Planning Commission or the Department of Planning. · Section 5. This ordinance shall be 6ffectlve for a period of one (mi) year from the date of .adoption thereof, and that unless extended as provided by law, it shall be terminated on such date and all provisions of the other ordinances repealed hereby shall be ~ainstated upon such termination. ' Section 6. Durlng~.the term of this ordinance, no dUp'l~es, triplexes, multiple family d~ellings or apart- ment houses shall be authorized for construction either by zoning, by use variance or permit, or by any other act of the City or departments thereof. (b) Referendum Ordinance No. 236: Shall the Ordinance changing the property of Muth from the "U" Zone to the "PD" Zone be adopted? Said Ordinance reads as follows: AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA CHANGING PROPERTY FROM THE "U" TO THE #PD" ZONE, ON APPLICATION NO. Z.C. 63-124 OF MUTH. The City Council of the City of Tustin, California does ordain as follows: Sect ionl. The City Council finds and determines that a proper application (No. Z.C. 63-124) was filed on behalf of Muth for change of zone from the #U" to the ~PD" zone of the property described as follows: · The Southeasterly half of the Southerly quarter of Lot 48 Plat No. I of the Ranchos '~Santiago De Santa Ana and San Joaquln in the County of Orange, State of California, as per Map thereof recorded in Book 5, Page 7, Miscellaneous Records of LosAngeles County California, excepting the Southwesterly forty feet thereof. Section 2: ~he Planning Commission duly called, noticed and he~'da public hearing on said application, and recommended said zone change. ~Sectlon 3: The City Council duly called, notlced and held a ~ublic hearing on said application on September 3, 1963. sec~!.gn_..4~.: The City Council finds and determines that said proposed zone change is ~n the best interests of the subject property, adjacent property and adjoining uses, and is in harmony with the general plan of the City. Section 5: ~bne aforesaid property is hereby changed from the "U" zone to the "PD"'zone, and the zoning map of the City is hereby amended accordingly. (c) Referendum Ordinance No. 237: Shall the Ordinance changing th~ property of Newport Colonial Corporation from the "U" zone to the "PD" zone be adopted? Said Ordinance reads as follows: AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, CHANGING FROM THE "U" TO THE "PD" ZONE THE PROPERTY OF NEWPORT COLONIAL CORPORATION, , -. The City Council of the City of Tustin, California does ordain~ aa follows: ~Section 1. The City Council finds and determines that ~ p~oper application (No. Z.C. 63-126) was filed on behalf of NEWPORT COLONIAL CORPORATION for change of zone from the "U" Zone to the "PD" Zone of the property described Property in the State of California, County of Orange, --~ described as The North 8 acres of Lot "H" of the "Stafford and Tustin Tract~, as per map re~orded in Book 2, Pages 618 and 619, Miscellaneous Records of Los Angeles County, California; ~and The East 10 ac~es of the following: Commencing at the Northwest corner of Lot "I" of the "Stafford and Tustin Tract" as shown on a map thereof recorded in Book 2, pages 618 and 619 Miscellaneous records of Los Angeles County, ~ California, running thence South 67.25 rods to the land formerly owned by Ed Abbott; thence East 48 rods; thence North 67.25 rods and thence West to the point of beginning. Section 2.. The Planning Commission duly called, noticed, ahd'held a public hearing on said application, and recommended said zone change to the City Council. Section 3. The City Council duly called, noticed and held a-public hearing on said application on September 3, 1963. Section 4. The City Council finds and determines that said rezoning is in the best interests of the subject property, adjacent property and adjoining uses, and is in harmony with the general plan of the "City of Tustin. Section 5. The City Council hereby changes the aforesaid property to the "PD" zone, and the zoning map Of the City is hereby accordingly amended. (d) Referendum Ordinance No. 238: Sha~l the Ordinance changing the property of Meurs from the ~U" zone to the "PD# mone be adopted? Said Ordinance states as follows: AN ORDINANCE OF THE CITY 'OF TUSTIN, · CALIFORNIA, CHANGING FROM THE #U" ZONE TO THE "PD" ZONE THE PROPERTY OF MEURS. ~ , The .City Council of the City of Tustin, California,~ does ordain as follows: Section 1. '?~e City Council finds and determines that a '~roper application (No: Z.C. 63.127) was filed on behalf of Meurs for rezonlng from 'the "U" to the #PD" zone the~ property described as follows: Beg~i. nning at? .point off the monumented' center line of Williams ~'~'St.reet, as shown on Stafford and Tustin Tract as per a Map thereof recorded in Book 2, Page 618 .of .Miscellaneous Records of Los Angeles' County, California, said point being 480.12 feet South of the 'intersection of said monumented center line with the center line of'MalnoStreet as shown on said Map thence running South 88 53' 15'' west 828.50 feet to a point in the west line of Lot "H" of said tract, said point being marked by an iron pipe set in the top of the irrigation pipe line; thence south 0° 33' east 569.80 feet along said west line of Lot #H" to a cross in th~ top of said irrigation pipe llne; thence north 8~° 33' 15" east 830.76 feet to a point in the said monumented senter line of Nilllams Street, thence north 0 o 46~' 15" west along said monumented center line a distance of 565 feet to the point of beginning. Section 2. The Planning Commission duly called, noticed, an~ hei~d~a public hearing on said application, and recommended said change of zone. Sectlon 3. The City Council duly called, noticed, and held a public hearing on said application, on September 3, 1963. Section 4. ~he City Council finds and determines that said zone c~anfe~s in the best interests of the subject property, adjacent property, ad joining uses and is in harmony wi th the general plan'of the City. That the whole number of votes cast in said CitY was 3406, (except absent voter ballots). That the whole number of absent votes cast in said City was 25, making a total of 3431 votes cast in said City. That the whole number of ballots voted in said City was 863 (except absent .voter ballots). (b) Referendum Ordinance No. 236: Defeated (c) Referendum Ordinance No. 237: Defeated (d) Referendum Ordinance No. 238: Defeated Section 6: The City Clerk shall enter on the records Of the ~'City Council of said City a statement of the result of said election: l) The whole number of votes cast in the City. 2) ~he measures voted upon. · 3 The number of votes given at each p~ecinct for each measure. Section 7: That the City Clerk shall certify to the passage and-adoption of this resolution; shall enter the same in' the book of original resolutions of said City; and shall make a minute order of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
